Police Force and their Widows and P o T lhiece (P ensions ) Children. A ct of 1955. [A ssented to 2 nd D ecember , 1955.] E E it enacted by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legis lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:— 1. (1.) This Act may be cited as “The Police short title. (Pensions) Act of 1955.” (2.) *“ The Police Acts, 1937 to 1954,” are in this Principal Act referred to as the Principal Act. Aot- (3.) The Principal Act and this Act may be Collective collectively cited as “ The Police Acts, 1937 to 1955.” title- (4.) This Act shall be deemed to have commenced Commence- on the first day of July, one thousand nine hundred and ™®tnt ofthia fifty-five, and shall have retrospective operation and effect accordingly. 2. (1.) In this section the term “ existing pensioner ” Super means ex-member of the Police Force or widow or child allowances in respect of whom there was paid immediately prior to and other the commencement of this Act out of The Police p^bie Superannuation Fund a superannuation allowance or from other sum pursuant to the Principal Act. tespeot5ofm (2.) On and after the commencement of this Act the annual rates oi superannuation allowances and other sums payable out of The Police Superannuation Fund in respect of the various classes of all existing pensioners shall be— (i.) In the case of each ex-member of the Police Force, such annual rate of superannuation allowance as he would have become entitled to pursuant to the Principal Act if he had retired from the Police Force immediately prior to the commencement of this Act with the same rank and period of service in the Police Force as he held and had at the time of his actual retirement: * 1 G. 6 No. 12 and amending Acts.

Provided that no superannuation allowance payable in respect of any such existing pensioner— (а) Shall pursuant to this subparagraph (i.) be increased beyond the annual rate of three hundred and sixty-four pounds ; or (б) Shall in consequence of this subparagraph (i.) be reduced below the annual rate actually received by him immediately prior to the commencement of this Act; (ii.) In the case of a widow or child such annual rate as would have been payable pursuant to the Principal Act in respect of that person if such sum had first become payable in respect of that person immediately prior to the commencement of this Act: Provided that no sum payable in respect of any such existing pensioner— (а) Shall pursuant to this subparagraph (ii.) be increased beyond the annual rate of one hundred and eighty-two pounds; or (б) Shall in consequence of this subparagraph (ii.) be reduced below the annual rate actually paid in respect of that person immediately prior to the commencement of this Act. Super annuation allowances and other sums payable in respect of new pensioners. 3. (1.) On and after the commencement of this Act the annual rate of every superannuation allowance and other sum payable pursuant to the Principal Act from The Police Superannuation Fund in respect of persons to whom this section applies shall be increased by one-fifth. (2.) The provisions of this section shall apply only to ex-members of the Police Force retired from that Force on or after the commencement of this Act and to widows and children in respect of whom a superannuation allowance or other sum pursuant to the Principal Act is first payable on or after the commencement of this Act from The Police Superannuation Fund.
