Police Offences Regulations 2007

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Police Offences Act 1935 .19 November 2007

1Short titleThese regulations may be cited as the Police Offences Regulations 2007 . 2CommencementThese regulations take effect on the day on which the Police Offences Amendment Act 2007 commences. 3InterpretationIn these regulations – Act means the Police Offences Act 1935 . 4Public places to which section 25 of Act applies (1)  A public place specified in subregulation (2) is taken to be a public place to which section 25 of the Act applies only during the periods specified in subregulations (3) and (4) and at the times specified in those subregulations. (2)  For the purposes of subregulation (1) , the public places are as follows: (a) the area of Crown land specified in Part 1 of Schedule 1 and known as Salamanca Lawns; (b) the area of Crown land specified in Part 2 of Schedule 1 and known as Princes Park; (c) the area of Crown land specified in Part 3 of Schedule 1 and known as St Davids Park; (d) the area of Crown land specified in Part 4 of Schedule 1 and known as Franklin Square; (e) the area of Crown land specified in Part 5 of Schedule 1 and known as Parliament House grounds; (f) the area of Crown land specified in Part 6 of Schedule 1 and known as Tasman Monument. (3)  For the purposes of the public places specified in paragraphs (a) , (c) , (d) , (e) and (f) of subregulation (2) , the periods and times are – (a) from 10 December to 1 January inclusive in each year between the hours of 3 p.m. and 10 a.m. on the following day; and (b) from 2 January to 9 December inclusive in each year between the hours of 10 p.m. and 10 a.m. on the following day. (4)  For the purposes of the public place specified in paragraph (b) of subregulation (2) , the period and time is every day of the year between the hours of 10 p.m. and 10 a.m. 5Prescribed amounts for purposes of section 49(6) of Act (1) For the purposes of section 49(6)(a)(i) of the Act, the prescribed amount is $10 000 000. (2) For the purposes of section 49(6)(a)(ii) of the Act, the prescribed amount is $15 000 000. (3) For the purposes of section 49(6)(a)(iii) of the Act, the prescribed amount is $15 000 000. These regulations are administered in the Department of Police and Emergency Management.

EXPLANATORY NOTE

(This note is not part of the regulation) These regulations –

(a) provide that the public places specified in the regulations are taken to be public places to which section 25 of the Police Offences Act 1935 applies during the periods and at the times specified in the regulations. (Section 25 relates to the consumption of liquor in public streets and public places); and (b) prescribe the amounts for the purposes of section 49(6)(a) of the Police Offences Act 1935 . ( Section 49 relates to permits for certain motor vehicle races and the policies of insurance required for those motor vehicle races).
