Police Offences (Liquor) Regulations 2005

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Police Offences Act 1935 .22 August 2005

1Short titleThese regulations may be cited as the Police Offences (Liquor) Regulations 2005 . 2CommencementThese regulations take effect on the day on which their making is notified in the Gazette. 3Penalty under liquor infringement noticeFor the purposes of section 61(2) of the Police Offences Act 1935 , the prescribed penalty is 1 penalty unit. 4Form of withdrawal noticeFor the purposes of section 62(2) of the Police Offences Act 1935 , a notice withdrawing a liquor infringement notice is to be in accordance with the formin Schedule 1 . 5Legislation rescindedThe legislation specified in Schedule 2 is rescinded. These regulations are administered in the Department of Police and Public Safety.

EXPLANATORY NOTE

(This note is not part of the regulation) These regulations –

(a) prescribe the penalty payable in respect of a liquor infringement notice; and (b) prescribe the form of notice for withdrawing a liquor infringement notice; and (c) rescind the Police Offences (Liquor) Regulations 1996 .
