   Police Force (Member Testing) Amendment

   Regulations (No. 2) 2018

   Made by the Commissioner of Police with the approval of the Minister for Police.

   1.   Citation

These regulations are the Police Force (Member Testing)
Amendment Regulations (No. 2) 2018.

2.   Commencement

These regulations come into operation as follows —

(a)	regulations 1 and 2 — on the day on which these regulations are published in the Gazette;
(b)	the rest of the regulations — on the day after that day.

3. Regulations amended

These regulations amend the Police Force (Member Testing)
Regulations 2011.

4.           Regulation 3 amended

In regulation 3 in the definition of approved sample collector delete "to collect samples of breath, oral fluid, urine and hair" and insert:

5. Regulation 6 amended

(1) Before regulation 6(1) insert:

(1A) In this regulation —

sample type means any of the following types of

sample —

(a)	a breath sample;
(b)	an oral fluid sample;
(c)	a urine sample;
(d)	a hair sample.

(2) In regulation 6(1) delete "undergone training to collect samples
of breath, oral fluid, urine and hair in accordance with standards
approved under regulation 12(1), is to be an approved sample

collector" and insert:

been trained to collect a sample type is to be an approved

sample collector in relation to the sample type

(3) After regulation 6(1) insert:

(IAA) A person has been trained to collect a sample type if
the person has been trained to collect the sample type
in accordance with any relevant standards and

protocols approved under regulation 12(1).

6. Regulation 13 amended

(1)	Delete regulation 13(1) and insert:
(1) This regulation applies if a selected member is requested by an approved person to provide a sample of breath.
(2)	After regulation 13(1) insert:

(IA) The selected member must, in accordance with the

directions of the approved person, provide a sample to
an authorised person or approved sample collector for a
preliminary test of the sample.

7. Regulation 22 amended
In regulation 22(2) delete "drug analyst," and insert:

drugs analyst,

8. Regulation 23 amended
In regulation 23:

(a) delete "drug analyst" and insert:

drugs analyst

(b) delete "analyst" and insert:

drugs analyst

Note: The heading to amended regulation 23 is to read:

Drugs analyst to report result to Commissioner

9. Regulation 30 amended
In regulation 30(2) delete "drug analyst" and insert:

drugs analyst
