Police Force Amendment Regulations

(No. 3) 2018

Made by the Commissioner of Police under section 9 of the Act.

1.   Citation

These regulations are the Police Force Amendment Regulations

23 November 2018 GOVERNMENT GAZETTE, WA 4553

2.     Commencement

These regulations come into operation as follows -

(a) regulations 1 and 2— on the day on which these

regulations are published in the Gazette;

(b) the rest of the regulations - on the day after that day.

3. Regulations amended
These regulations amend the Police Force Regulations 1979.

4.      Regulation 1310 inserted

After regulation 1309 insert:

1310. Application of r. 1302, 1303, 1304, 1305, 1306, 1308

and 1309 to Commissioner

(1) Regulations 1302, 1303, 1304(l),1305, 1306, 1308
and 1309 apply to the Commissioner as if—

(a) references to a member were references to the

Commissioner; and

(b) references to the member's officer in charge,

Commissioner or Manager were references to the Minister.

(2)	In respect of a period of leave of absence approved under regulation 1304(1), as applied by subregulation (1), the Commissioner is entitled to receive any allowances that the Commissioner would have received under the terms of the Commissioner's appointment if the Commissioner had not been incapacitated.
(3)	Subregulation (2) applies subject to any terms or

conditions imposed under regulation 1304(1 )(b), as

applied by subregulation (1).

(4) Subregulation (2) does not apply if the Commissioner
is incapacitated through the Commissioner's fault or
misconduct.
