POLICE FORCE AMENDMENT REGULATIONS 1990

Made by the Commissioner of Police under section 9 with the approval of the
Minister for Police and Emergency Services.
Citation
1. These regulations may be cited as the Police Force Amendment Regulations
1990.
Part VIIIA repealed and a Part substituted
2. Part VIIIA of the Police Force Regulations 1979* is repealed and the following

part is substituted—

execution of duty.

PART VIIIA—RECOGNITION OF BRAVERY AND MERIT

Interpretation of Part

8A01. In this Part—

"award" means any award designated in regulation 8A02;

"Committee" means the Police Honours and Awards Committee re-

ferred to in regulation 8A11;

"member of the Force" means a member, cadet, aboriginal aide or

special constable.

Classes of awards
to a member of the Force who is eligible under the criterion shown opposite the designated award.
8A02. The Commissioner may, under a recommendation made by the

Certificate of Merit	Display in the execution of duty of initia- tive, resourcefulness and courageous ac- tion, putting aside thought of personal safety, greater than what might reasona- bly be expected.
Special Commendation	Meritorious conduct under stressful condi- tions in the course of field operational duty.
Commendation	Display of initiative, resourcefulness and devotion to duty reflecting credit on the Force.

Nature of awards

8A03. Each award consists of what is specified in the following table—

Part 1 of the Fourth Schedule

(2)A citation from the Commissioner de- scribing the act for which the award is granted

Bar to the Award for (1) A bar and rosette, as described in Part

Bravery 2 of the Fourth Schedule

(2)A citation from the Commissioner de- scribing the act for which the award is granted

Certificate of Merit	A certificate from the Commissioner de- scribing the conduct for which the award is granted
Special Commendation	A letter from the Commissioner
Commendation	A letter from the Commissioner

Nomination for an award
8A04. (1) A member of the Force may be nominated for an award by any
person, including another member of the Force.

(2) A nomination must be in writing.

Determination of nominations

8A05. (1) A nomination must be determined by the following procedure—

(a) reference of the nomination to the commander of the Inspectorate;

(b)	reference of the matter by the commander of the Inspectorate to a Commissioned Officer;
(c)	an inquiry by that Commissioned Officer or a Commissioned Officer appointed by him and consideration by the inquiring Commissioned Officer of whether the grant of an award may be warranted, in light of the eligibility criteria specified in regulation 8A02 and taking into account the guidelines referred to in regulation 8A10;
(d)	where the inquiring Commissioned Officer concludes that the grant
him to the Chief Superintendent of the portfolio within which the of an award may be warranted, forwarding of a written report by

nominated member of the Force is performing duty;

(e)	transmission of that report by the Chief Superintendent of the portfolio concerned (with or without comments by him) to the commander of the Inspectorate;
(f)	arrangements by the commander of the Inspectorate for the nomination and the associated report prepared to be considered by the Committee;
(g)	consideration of the nomination and the associated report by the Committee and, where the Committee is of the opinion that an award should be granted, a written recommendation to the Com- missioner specifying the award.

(2) In carrying out its function, the Committee may make whatever

enquiries it considers appropriate.

Record of awards
8A06. The Commissioner shall ensure that the following action is taken to

record the grant of an award—

(a)	making of a record in the personal file of the member of the Force concerned; and
(b)	except in the case of a Commendation, publication of particulars of the award in the Police Gazette.

Letters after name
8A07. A member of the Force who is granted the Award for Bravery is
entitled to have the letters "Cr.B." after his name in all official documents
of the Force, and if he is later granted the Bar to the Award for Bravery,

the letters are to be followed by an asterisk.

Wearing of awards
8A08. A member of the Force who is granted an award which is described
in the Fourth Schedule may wear that award only on the right side of the

chest.

Posthumous awards
8A09. An award may be presented posthumously to the closest relative of
a member of the Force who has earned an award, or to a person nominated

by that relative.

Guidelines for consideration of nominations
8A10. The Commissioner shall prescribe guidelines for use by Commis-
sioned Officers in considering whether the grant of an award to a member

of the Force nominated for an award may be warranted.

Police Honours and Awards Committee
8A11. (1) For the purposes of this Part, there shall be a committee to be
known as the Police Honours and Awards Committee.

(2) The Committee is to consist of—

(a) the Commissioner;
(b) the Deputy Commissioners;
(c) the Assistant Commissioners; and
(d) an officer of the Department appointed by the Commissioner.

(3) The Committee may determine its procedure and the provisions of the Interpretation Act 1984 which would otherwise apply in relation to the procedure of the Committee apply only to the extent to which they are not inconsistent with determinations made by the Committee. ".
