Alteration of other rules of organisation.

[1]        On 12 November 2015 the New South Wales Police Branch of the Police Federation

of Australia (the Branch) lodged with the Fair Work Commission a notice and declaration

setting out particulars of alterations to its Branch Rules.

[2]        The particulars set out alterations to New South Wales Police Branch Rules 52EG and

52ER. The proposed rules seek to correct potential inconsistencies between the Branch Rules

and the rules of the Associated Body, the Police Association of NSW and to align the terms of

office for certain officers.

[3]        The alterations also provide that the specified officers can exercise an additional vote

in the event that there is a vacancy in an office of Delegate to Federal Council which has yet

to be filled.

[4]        On 8 December 2015, Scott Weber, Branch President, gave consent, under subsection

159(2) of the Fair Work (Registered Organisations) Act 2009 (the RO Act), for me to make

various amendments to the alterations for the purpose of correcting typographical, clerical or

formal errors. Accordingly the following corrections have also been made to the rules of the

Organisation:

In proposed rule 52ER A, replace “Rule 52EH” with “rule 52EH”;
In proposed rule 52ER B, replace “Rule 52EH” with “rule 52EH”; and
In proposed rule 52ER B, replace “Clause 52 EH” with “rule 52EH”,

[5]        On the information contained in the notice, I am satisfied the alterations have been

made under the rules of the organisation.

[6] In my opinion, the alterations comply with and are not contrary to the RO Act, the

Fair Work Act 2009, modern awards and enterprise agreements, and are not otherwise

contrary to law. I certify accordingly under subsection 159(1) of the RO Act.
