Alteration of other rules of organisation.
On 24 July 2019 the Police Federation of Australia (the Federation) lodged with the Fair Work Commission a notice and declaration setting out particulars of alterations to its Federal Rules. On 13 August 2019, the Federation advised that a notice had been placed on its website, indicating that the alterations had been lodged.
The particulars set out alterations to Federal Rules 14, 15, 21 and 27.
The alteration to Federal Rule 15 corrects an erroneous cross reference to another of Federation’s rules.
The alterations to Federal Rules 14 and 27 operate in concert. Taken together, they clarify the circumstances in which a member ceases to be eligible to nominate for or retain office in the Federation.
The alterations to Federal Rule 21 extend the terms of office of the Federation’s President, Vice Presidents, Treasurer and Federal Executive Members from one to two years, commencing from next scheduled terms of those offices.
On the information contained in the notice, I am satisfied the alterations have been made under the rules of the organisation.
On 13 August 2019, the Federation’s President Mark Carroll, gave consent, under subsection 159(2) of the Fair Work (Registered Organisations) Act 2009 (the Act), for the Delegate to amend the alterations for the purpose of correcting a typographical, clerical or formal error. Accordingly, the following correction have been made:
· In the third sentence of proposed Federal Rule 21(c)(i) the second appearing instance of the word “the” has been changed to the word ‘that’, instead of the first instance.
In my opinion, the alterations comply with and are not contrary to the Act, the Fair Work Act 2009, modern awards and enterprise agreements, and are not otherwise contrary to law. I certify accordingly under subsection 159(1) of the Fair Work (Registered Organisations) Act 2009.
