Alteration of other rules of organisation.

  1. On 19 March 2019 the Police Federation of Australia - Western Australia Police Branch lodged with the Fair Work Commission a notice and declaration setting out particulars of alterations to its rules.

  1. The particulars set out alterations to Part CA, Western Australia Police Branch Rules;

52AA – Branch Office Bearers

52AO – Executive Elections

  1. The alteration to Rule 52AA will correct the title for the South West Region.

  1. The alteration to Rule 52AO will enable candidates for election of office positions of the Branch Executive to lodge their nominations with a supporting statement. This supporting statement will not exceed 250 words together with a photograph not exceeding 6 cm x 4 cm in size. Alterations also correct typographical errors and update reference to legislation.

  1. On the information contained in the notice, I am satisfied the alterations have been made under the rules of the organisation.

  1. On 12 April 2019, Harry Sean Arnott, Branch President, gave consent, under subsection 159(2) of the Fair Work (Registered Organisations) Act 2009, for the Delegate to make various amendments to the alterations for the purpose of correcting typographical, clerical or formal errors. Accordingly the following corrections have been made:

    ·   In proposed rule 52AO (9)(b)(ii), the numbering sequence is inconsistent and should be numbered 9(b)(i);

    ·   In proposed rule 52AO (9)(b)(iii), the numbering sequence is inconsistent and should be numbered 9(b)(ii);

    ·   In proposed rule 52AO (9)(b)(iii), the sentence should have a semi colon instead of a comma, after the word ‘Regulations’ and before the word ‘and’.

  1. In my opinion, the alterations comply with and are not contrary to the Fair Work (Registered Organisations) Act 2009, the Fair Work Act 2009, modern awards and enterprise agreements, and are not otherwise contrary to law. I certify accordingly under subsection 159(1) of the Fair Work (Registered Organisations) Act 2009.
