Police (Drug Testing) Amendment Act 2017

An Act to amend the Police Act 1998.

The Parliament of South Australia enacts as follows:

Part 1Preliminary1Short title

This Act may be cited as the Police (Drug Testing) Amendment Act 2017.

2Commencement

This Act will come into operation on a day to be fixed by proclamation.

3Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.

Part 2Amendment of Police Act 19984Amendment of section 41A – Interpretation
  1. (1)

    Section 41A(1)—after the definition of drug and alcohol testing insert:

    drug screening test means a test by means of an apparatus of a kind approved by the regulations for the conduct of drug screening tests;

  2. (2)

    Section 41A(1), definition of oral fluid analysis—delete the definition and substitute:

    oral fluid analysis means the analysis of a person's oral fluid to determine whether a drug is present in the oral fluid;

5Amendment of section 41B – Drug and alcohol testing of members and cadets

Section 41B(1)—after paragraph (a) insert:

  1. (ab)

    to submit to a drug screening test for the purpose of testing for the presence of drugs;

6Amendment of section 41C – Drug and alcohol testing of applicants to SA Police

Section 41C(1)—after paragraph (a) insert:

  1. (ab)

    to submit to a drug screening test for the purpose of testing for the presence of drugs;
