820 Police Complaints Tribunal Act Amendment Act 1987, No. 60 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short Title . This Act may be cited as the Police Complaints Tribunal Act Amendment Act 1987. 2. Citation . (1) In this Act the Police Complaints Tribunal Act 1982- 1985 is referred to as the Principal Act. (2) The Principal Act as amended by this Act may be cited as the Police Complaints Tribunal Act 1982-1987. 3. Amendment of s. 3. Interpretation . Section 3 of the Principal Act is amended by inserting before the definition "Commissioner" the following definition:- "Chairman" means the Chairman of the Tribunal and includes any person for the time being acting as the Chairman;". 4. Amendment of s. 4. Tribunal . Section 4 of the Principal Act is amended in subsection (3) by omitting the words "required for the purposes of' and substituting the words "permitted by". 5. Amendment of s. 7. Secretary of Tribunal . Section 7 of the Principal Act is amended in subsection (2) by omitting the words "required for the purposes, of" and substituting the words "permitted by 6. New s . 14A. The Principal Act is amended by inserting after section 14 the following section:- "14A. Permitted disclosure of information . (1) Information concerning matters coming to the knowledge of a member or the secretary of the Tribunal in the course of his duties as such member or, as the case may be, secretary may be disclosed- (a) if the disclosure is required for the purposes of this Act; or (b) with the approval of the Governor in Council, upon the recommendation of the Chairman , first had and obtained, if the , disclosure is (i) to a person holdin g office or a body constituted under an Act or under a law of the Commonwealth or a State ( other than Queensland ) or a Territory of the Commonwealth; or (ii) to a body operating pursuant to agreement between Queensland and the Commonwealth or any other State or Territory of the Commonwealth, being a person or body that in the Chairman's opinion discharges functions for purposes that correspond,

(2) Where information is to be disclosed pursuant to this section the production of the information may be effected by the Chairman or by a person authorized in writing by him, either generally or in a particular case.". 7. Ratification of certain disclosures . A disclosure before the passing of this Act of information concerning matters that came to the knowledge of a member or the secretary of the Tribunal in the course of his duty as such member or, as the case may be, secretary, being a disclosure made to or for the purposes of a Commission of Inquiry within the meaning of The Commissions of Inquiry Acts 1950 to 1954, is hereby declared to be lawful and not to constitute a breach of duty to preserve secrecy concerning any matter had by any person as required by the Principal Act.
