Act No. 222, 1987
An Act to amend the Police Association Employees (Superannuation) Act
(Superannuation) Amendment Act 1987. [Assented to 9 December 1987] 1969 as a consequence of the enactment of the Police Regulation Police Association Employees (Superannuation) Amendment 1987 The Legislature of New South Wales enacts:
Short title
1. This Act may be cited as the Police Association Employees
(Superannuation) Amendment Act 1987.
Commencement
2. This Act shall commence on a day or days to be appointed by
proclamation.
Amendment of Act No. 33, 1969
3. The Police Association Employees (Superannuation) Act 1969 is
amended as set out in Schedule 1.
SCHEDULE 1—AMENDMENTS
(Sec. 3)
(1) Section 2 (Definitions)—
Section 2 (1), definition of "Board"—
Omit the definition, insert instead:
"Board" means the State Authorities Superannuation Board
constituted by the Superannuation Administration Act 1987;
(2) Section 2 A —
After section 2, insert:
Act applies only to contributors to Police Superannuation Fund
2A. This Act applies to and in respect of a member of the police
force who transfers to the employment of the Association only if the member was a contributor to the Fund immediately before the transfer.
(3) Section 3 (Employees of Association transferring from police force)—
(a)
Section 3 (1) (a) (i)— Omit "and".
(b)
Section 3 (1) (a) (ia)— After section 3 (1) (a) (i), insert:
(ia) has not made provision for a benefit under section 9B of
the Police Regulation (Superannuation) Act 19063 Act No. 222

(d) Section 3 (2B)— After section 3 (2A), insert:
(2B) For the purpose of the application of section 8A of the Police Regulation (Superannuation) Act 1906 to the prescribed person—
(a)
the Board may offer the prescribed person a disengagement benefit under that section if the prescribed person is retrenched (within the meaning of the State Authorities Superannuation Act 1987); and
(b)
subsections (2), (5), (6), (7) and (9) of that section apply, and the other provisions of that section do not apply, to the prescribed person.
(e) Section 3 (8A)— After section 3 (8), insert:
(8A) A superannuation allowance granted to the prescribed person under subsection (2) may be commuted, in accordance with Division 3 of Part IV of the Police Regulation (Superannuation) Act 1906, as if it were a superannuation allowance payable to a member of the police force under that Act.
(f) Section 3 ( H E ) —
After section 3 (1 ID), insert: ( H E ) An annual superannuation allowance is not payable under this section as the consequence of the death of the prescribed person if the prescribed person commuted under subsection (8A) a superannuation allowance payable to the prescribed person under this section.
(g) Section 3 (13)—
After section 3 (12), insert:

(4) Section 5 (Appeals)—
