AN ORDINANCE
To provide fox* the Establishment of an Arbitral Tribunal for the purpose of determining the Remuneration and the Terms or Conditions of Service of Members of the Police Force.

(2.) The Police Ordinance 1927-1943 is in this Ordinance referred to as the Principal Ordinance.
(3.) The Principal Ordinance, as amended by this Ordinance, may be cited as the Police Ordinance 1927-1947.
2. Section four of the Principal Ordinance is amended by Definitions,
inserting, before the definition of "Chief Officer", the following
definition:—
"" Chairman of the industrial Board' means the person for the time being holding that office und'er the Indus- trial Board Ordinance 1936-1346, and, in the event of the absence of that person, whether through illness . or otherwise, means the person for the time being holding the office of Deputy Chairman of the Industrial Board under that Ordinance;".
3. Section five of the Principal Ordinance is amended bv Appointment

' 4. After section five of the Principal Ordinance the following section is inserted:—
" 5 A . — (1.) There shall be a Police Arbitral Tribunal' which Police
shall have jurisdiction to hear and determine all matters relating Tribunal,
to the remuneration and the terms or conditions of service of
members of the Police Force.
" (2.) The Tribunal shall be constituted by the Chairman of the Industrial Board and two other members appointed by the Governor-General.
" (3.) The members appointed in pursuance of sub-section (2.) of this section shall be—
(a) a person nominated by the Attorney-General; and

(b) a person elected by the members of the Police Associa- tion of the Australian Capital Territory and nominated in writing under the hand of the person for the time being performing the duties and func- tions of Secretary of that Association.
" (4.) Each person appointed in pursuance of sub-section (2.) of this section shall hold office for such a term as is specified in the instrument of appointment, not being more than three years, and, on the expiration of his term of office, each person so appointed shall, subject to this Ordinance, be eligible for re-appointment.
" (5.) The provisions of sections eight, nine and nine B of the Industrial Board Ordinance 1936-1946 shall apply in relation to members of the Tribunal in like manner as they apply in relation to members of the Industrial Board.
" (6.) Whenever the office of a member of the Tribunal appointed in pursuance of sub-section (2.) of this section becomes vacant, the Governor-General may appoint to be a member of the Tribunal in his stead a person nominated, or elected and nominated. as the case may be, in the same manner as the member whose office becomes vacant.
" (7.) The Chairman of the Industrial Board shall be the Chairman of the Tribunal and the provisions of the Industrial Board Ordinance 1936-1946 prescribing the powers, duties and functions of the Chairman and the Deputy Chairman in relation to the Industrial Board shall apply in relation to the Tribunal.
" (8.) There shall be a Secretary to the Tribunal who shall be appointed by the Attorney-General.
" (9.) The provisions of sections thirteen B, thirteen c, sixteen, sixteen A, seventeen, eighteen, twenty, twenty-one, twenty-two, twenty-three, twenty-four, twenty-five, twenty-six and twenty- seven of the Industrial Board Ordinance 1936-1946 shall apply in relation to the Tribunal, proceedings before the Tribunal and matters incidental thereto as they apply in relation to the Industrial Board and like proceedings and matters.
| " (10.) For the purpose of the application of the provisions of the Industrial Board Ordinance 1936-1946 effected by this section, the Police Association of the Australian Capital Territory shall be deemed to be an organization of Commonwealth employees.". |
