[A ssented to 22 nd N ovember , 1951.] 15 G eo . VI. No. 44. T he P olice A cts A mendment A ct of 1951 (No. 2). B E it enacted by the King’s Most Excellent Majesty, by and with the advice and consent of the Legis­ lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:— 1. This Act may be cited as The Police Acts Short title Amendment Act of 1951 (No. 2 ),” and shall be read as construction, one with * “ The Police Acts, 1937 to 1951,” herein referred to as the Principal Act. The Principal Act and this Act may be collectively Collective cited as “ The Police Acts, 1937 to 1951.” tltle- 2. The definition of the term “ Member, of the Amendment Police Force” appearing in section four of the Principal 0 s' ' Act is amended by repealing therein the words “ and every inspector” and by inserting, in lieu qf those repealed words, the words the Deputy Commissioner, and every inspector (including the Chief Inspector)”. 3. Subsection three of section six of the Principal Amendment Act is repealed. of 8'6­ 4. The following section is inserted after section New s. 7 a seven of the Principal Act, namely :— inserted. “ [7 a .] ( 1 .) The Governor in Council may from time Deputy to time appoint, in addition to the Commissioner, some missi"oner. fit and proper person to be the Deputy Commissioner of Police, herein in this Act referred to as the Deputy Commissioner. (2.) The Deputy Commissioner shall be paid a salary at such rate per annum as may be determined by the Governor in Council from time to time. (3.) The Deputy Commissioner shall, subject as hereinafter provided in this subsection, continue in office during such period as he is of good behaviour and until he attains the age of sixty-five years : 1 G. 6 No. 12 and amending Acts.

Provided that the disqualifications with respect to the office of the Commissioner imposed by subsection four of section six of this Act shall extend with respect to the office of Deputy Commissioner. (4.) The Deputy Commissioner shall, subject to this Act, exercise and perform all such powers, authorities, functions and duties (including such of the powers, authorities, functions and duties of the Commissioner) as the Commissioner may direct either generally or in any special case. In the event of and during the absence from duty for any reason whatsoever of the Commissioner, or in the event of a vacancy occurring in the office of Commissioner and until a new Commissioner is appointed, the Deputy Commissioner shall act as Commissioner and while he so acts shall have and may exercise all of the powers, functions, authorities and duties of the Commissioner. Any power, function, authority, or duty of the Commissioner exercised or performed by the Deputy Commissioner shall, until the contrary is proved, be presumed to have been so exercised or performed lawfully.” Amendments 5 . Subsection one of section twelve of the Principal of s. 12 (i). -g amen(ie(j— - (a) By repealing in paragraph (a) of the said subsection one the words “ twenty-seven years ” and by inserting, in lieu of those repealed words, the words “ thirty years ”. ( b ) By adding to the said subsection one the following proviso, namely :— “ Provided that preference shall be given to the younger men in making appointments as constables of police from a number of applicants who, except for their respective ages, are deemed equally suitable to be so appointed.” Amendment 6 . Section thirty-six of the Principal Act is of s. 36. amended by inserting therein, after the words “ Commissioner of Police,” the words “ and the holder of the office of Deputy Commissioner of Police ”.

(a) Subsection one thereof is amended by inserting therein, after the words “ other than the Commissioner”, the words the Deputy Commissioner (b) The following subsection is inserted after subsection four thereof, namely:— (4 a . ) Upon his retirement from the Police Force the Deputy Commissioner shall be entitled to a Xjwance of superannuation allowance at the rate of seven hundred *£ruty and fifty pounds per annum— miSioner. (а) If he shall have served for fifteen years or over in the Police Force ; or ( б ) If, not having served for fifteen years in the Police Force, he shall have been retired therefrom under and in pursuance of section thirty-seven of this Act.” PRIMARY PRODUCE. Amendment Act of 1951” and shall be read as one with *“The Primary Producers’ Organisation and Marketing Acts, 1926 to 1946”, herein referred to as the Principal Act. * 17 G. 5 No. 20 and amending Acts.
