ACT OF 1051. [ASSENTED TO 5TH APRIL, 1951.] B E it enacted by the King's Most Excellent Majesty, by and with the adyice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as fol1ows:- Short title 1. (1.) This Act maybe cited as " The Police Acts ~ ~~ struction Amendment Act of 1951," and shall be read as one with *" The Police Acts, 1937 to 1948," herein referred to as the Principal Act. The first paragraph of subsection one of that section is repealed and, in lieu of that repealed paragraph, the following paragraphs are inserted, namely:- "Subject as hereinafter provided, any and every member of the Police Force (other than the Commissioner and any such member holding, at the date of his retire- ment, the rank of Chief Inspector) who, when he retires therefrom under the foregoing provisions of this Act, shall have served fifteen years or over therein shall be entitled to receive a superannuation allowance at the following rate per annum, that is to say- (a) In the case of such a retiring member who shall have served for fifteen years or more but for less than twenty-five years-one --- - - - - . - - - - . - - - ~ - - - * 1 G. 6 No. 12 and amending Acts.

POLICE. - - - - - - - - - - - - - - - - - - - ~ Police Acts Amendment Act. hundred and fifty-six pounds per annum increased by an added sum of ten pounds for each and every year of service over fifteen; (b) In the case of such a retiring member who shall have served for twenty-five years or more but for less than twenty-nine years- two hundred and fifty-six pounds per annum increased by an added sum of fifteen· pounds for each and every year of service over twenty-five; (e) In the case of such a retiring member whO' shall have served for twenty-nine years but for less than thirty years-three hundred and thirty-six pounds per annum; (d) In the case of such a retiring member who shall have served for thirty years or more- three hundred and thirty-six pounds per annum increased by an added sum of fourteen pounds for each and every year of service over thirty but so that the total rate of superannuation allowance shall not exceed four hundred and seventy-six pounds per annum. Where the completed period of service in the Police Force over any period specified in subparagraph (a) or (b), or (d) of the first paragraph of this subsection consists of or includes a part of a year, then that part of a year shall be counted as a completed year of service in calculating the increased sum to be added to the annual amount of superannuation specified in that paragraph." (ii.) The proviso to the first paragraph of subsection one of that section (being the proviso added to that first paragraph by *" The Police Acts Amendment Act of 1948 (No. 2)") is repealed. (ill.) Subsections two and three of that section are repealed and, in lieu of those repealed subsections the following subsections are inserted, namely :- "(2.) Where a retiring member of the Police Force entitled under subsection one of this section to receive ' a superannuation allowance shall be, at his retirement, above the rank of constable, the amount of the rate per annum of that superannuation allowance calculated, * 13 G. 6 No. 13. 201

No. 20, according to the length of his service, under subparagraph (a), or (b), or (c) or (d) of the first paragraph of subsection one of this section, shall be increased as follows, that is to say- (a) In the case of a sergeant, 2nd class-by an added sum of twenty-five pounds per annum; (b) In the case of a sergeant, 1st class-by an added sum of forty pounds per annum; (c) In the case of a senior sergeant--by an added sum of sixty pounds per annum; (d) In the case of a sub-inspector-by an added sum of one hundred pounds per annum; (e) In the case of an inspector-by an added sum of one hundred and twenty-five pounds per annum. (3.) A member of the Police Force holding, at the date of his retirement, the rank of Chief Inspector shall, if he shall have served for fifteen years or over in the Police Force, be entitled to a superannuation allowance at the rate of seven hundred pounds per annum." (iv.) Subsection four of that section is amended by repealing the words "six hundred pounds" and by inserting, in lieu of those repealed words, the words " eight hundred pounds." Amendment 4. Subsection one of section forty-two of the of 8. 42 (1). Principal Act is amended by repealing the words " one hundred and four pounds", where those words appear in paragraph (b) of that subsection, and by inserting, in lieu of those repealed words, the words "two hundred and eight pounds ". Application 5. The amendments made by this Act to *" The of this Act. Police Acts, 1937 to 1948," shall not extend or apply to or in respect of- (i.) Any member of the Police Force who retired from the Police Force before the first day of October, one thousand nine hundred and fifty; or (ii.) Any member of the Police Force whose retirement from the Police Force had been approved or ordered by the Governor in Council before the first day of October, one one thousand nine hundred and fifty; or - - - - - - - - - - - - - - - - - - - - - - - - ~ * 1 O. 6 No. 12 and amending Acts.
POLICE. 1951. Police Acts Amendment Act. (iii.) Any widow ofa deceased married member of the Police Force, orofa pensionerwhere thatmember or pensioner died before the first day of October, one thousand nine hundred and fifty; or liv.) Any widow of a pensioner where that pensioner shall have died on or after the first day of October, one thousand nine hundred and fifty, if that pensioner had retired from the Police Force, or the retirement of that pensioner from the Police Force had been approved or ordered by the Governor in Council, before the first day of October, one thousand nine hundred and fifty; or (v.) Any widow of a married member of the Police Force whose retirement from the Police Force had been approved or ordered by the Governor in Council before the first day of October, one thousand nine hundred and fifty, where that member shall have died on or after the date of such approval or order and before the date upon which he is retired from the Police Force pursuant to such approval or order; but every such retired member of the Police Force, or member of the Police Force whose retirement had been so approved or ordered, or widow who had or- (vi.) In the case of such a member whose retirement had been so approved or ordered, would, if this Act had not been passed, have on and from the date of his retirement; or (vii.) In the case of the widow of a pensioner, or of a member of the Police Force whose retirement was approved or ordered by the Governor in Council before the first day of October, one thousand nine hundred and fifty, dying after that lastmentioned date, would, if this Act had not been passed, have on and from the date of the death of such pensioner or member, a right or claim to payment by way of superannuation or otherwise under the provisions of *" The Police Act8~ 1937 to 1948," in force immediately prior to the passing of this Act, shall continue to have such right or claim to the same extent as he or she would have had if this Act had not been passed, but not further or otherwise. * 1 G. 6 No. 12 and amending Acts. 203
