6694 PATENTS.-POLICE. Police Acts Amendment Act. 3 GEO. V. No. 32, (5.) After:the expiration of the prescribed period, the Governor in Council shall consider the application and any objection thereto, and any reply to such objection, and shall issue an Order either restoring the patent or dismissing the application: Provided that, in every Order under this section restor- ing a patent, provisions shall be inserted that persons who have actually made and put the patented invention into practice in Queensland after the patent had ceased, and before the publication of a notification in the Gazette of the Order restoring the patent, shall not be liable for infringement of the patent. (G.) Forthwith after any such Order is made such Clerk shall transmit a copy thereof to the officer in charge of the llegister of Patents, and such officer shall, on payment of all fees then due with respect to the patent, re'ltore the same on the said Register; and, save as last aforesaid, such restoration shall have the same effect as if the patentee had complied in all respects with the provisions of the Principal Act relating to p~ ments. [ASSENTED TO 12TH DECEMBER, 1912.J B E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Council and Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows : - Short title. 1. This Act may be cited as "The Police Acts Amendment Act uf 1912." "The Police Acts, 1838 to 1891,"* and this Act may together be cited as " The Police Acts, 183~ to 1912." .. 2 Vie. No. 2,11 Vie. POLICE. 5695 1912. Police Acts Amendment Act. 2. (1.) For the purposes of " The Police Acts, 1538 Appoint~ ent to 1912, " and 0 f any other Act now I . II force or hereafter osifonCeormomf IS- enacted, conferring powers and duties on the Commissioner Police. of Police, the Governor in Council may from time to time appoint some fit and proper person to be Commissioner of Police, herein referred to as the Oommissioner. (2.) The Oommissioner shall be appointed for such term not exceeding five years as the Governor in Council, thinks proper; and shall continue in office during such term if be is of good behaviour. The salary of the Oommissioner shall not exceeq. one thousand pounds per annum. (3.) In the case of the illness, absence, or suspension of the Oommissioner, the Governor in Oouncil may appoint some other person to act as the deputy of the Oommissioner during such illness, absence, or suspension; and such person shall, during the time for which he acts as such deputy, have all the powers and perform all the duties of the Commissioner. (4.) The Oommissioner shall be deemed to have vacated his office- (a) If he engages during his term of office in any paid employment outside the duties of his office; (b) If he becomes insolvent or compounds with his creditors, or makes any assignment of his salary for their benel-it, or takes advantage of any provision of any Act relating to insolvency; (c) If he becomes permanently incapable of per- forming his duties; or (d) If he resigns his office by writing under his hand addressed to the Governor in Oouncil, and such resignation is accepted by the Governor in Oouncil. 3. (1.)
