An Act to Amend "The Police Act of 1937," in THE POLICE ACT AMENDMENT certain particulars. ACT OF 1944. [ASSENTED TO 27TH NOVEMBER, 1944.] B E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- Short title 1. This Act may be cited as "The Police Act ::struction. Amendment Act of 1944," and shall be read as one with *" The Police Act of 1937," herein referred to as the Principal Act. Collective The Principal Act and this Act may be collectively title. cited as " The Police Acts, 1937 to 1944." Amendments of the Principal Act. Amendment 2. Section thirty-five of the Principal Act is of s. 35. amended by repealing the words "five shillings" and by inserting the words "fifteen shillings" in lieu of such repealed words. Amendment 3. Section forty of the Principal Act is amended as ofs.40. follows : - (a) In subsection one thereof the words " and, where the completed period of service in the Police Force over the said fifteen years consists of or includes any part of a year, an additional sum bearing the same proportion to five pounds as the number of months in such part bears to twelve" are inserted after the words "the said fifteen years". * 1 G. 6 No. 12, v. 6, p. 922.
1944. POLICE. Police Act Amendment Act. 401 (b) Subsection two thereof is repealed and the following subsection is inserted in lieu thereof, namely:- "(2.) Provided that if a member of the Police Force retires from the Police Force under the foregoing pro- visions of this Act and is at the date of such retirement a non-commissioned officer with the rank of sergeant, 2nd class, or a non-commissioned officer with a rank higher than that of sergeant, 2nd class, and such non-commissioned officer has when he retires served fifteen years or over in the Police Force, such non- commissioned officer shall be entitled to receive an additional allowance over and above the superannuation allowance as calculated in accordance with the first paragraph of subsection one of this section as follows : - (i.) In the case of a senior sergeant-at the rate of forty pounds per annum; and (ii.) In the case of a sergeant, 1st class-at the rate of thirty pounds per annum; and (iii.) In the case of a sergeant, 2nd class-at the rate of twenty pounds per annum: Provided always that the total superannuation allowance (including the additional allowance as afore- said) on retirement shall not- (a) In the case of a senior sergeant-exceed a rate of two hundred and ninety pounds per annum; or (b) In the case of a sergeant, 1st class-exceed a rate of two hundred and eighty pounds per annum; or (c) In the case of a sergeant, 2nd class-exceed a rate of two hundred and seventy pounds per annum." 4. Paragraph (b) of subsection one of section Amendment forty-two of the Principal Act is amended by repealing of s. 42. the words "of sixty pounds" and by inserting the words " at tlie rate of one hundred and four pounds" in lieu of such repealed words.
402 POLICE. Police Act Amendment Act. 8 GEO. VI. No. 7, Application 5. The amendments made by this Act to *" The of this Act. Police Act of 1937," shall not extend or apply to or in respect of- (i.) Any member of the Police Force who retired from the Police Force before the date of the passing of this Act; or (ii.) Any member of the Police Force whose retirement from the Police Force had been approved or ordered by the Governor in Council before the date of the passing of this Act; or (iii.) Any widow of a deceased married member of the Police Force, or of a pensioner where such member or pensioner died before the date of the passing of this Act; or . (iv.) Any widow of a pensioner where such pensioner dies on or after the date of the passing of this Act, if such pensioner had retired from the Police Force, or the retire- ment of such pensioner from the Police Force had been approved or ordered by the Governor in Council, before the date of the passing of this Act; or (v.) Any widow of a married member of the Police Force whose retirement from the Police Force had been approved or ordered by the Governor in Council before the date of the passing of this Act where such member has died or dies on or after the date of such approval or order and before the date upon which he is retired from the Police Force pursuant to such approval or order ; but every such retired member of the Police Force, or member of the Police Force whose retirement had been so approved or ordered, or widow who had or- (vi.) In the case of such member whose retirement had been so approved or ordered, would, if this Act had not been passed, have on and from the date of his retirement; or (vii.) In the case of the widow of a pensioner, or of a member of the Police Force whose retirement was approved or ordered by the * 1 G. 6 No. 12, v. 6, p. 922.
1944. Police Act Amendment 'Act. Governor in Council before the date of the passing of this Act, dying after the date of the passing of this Act, would, if this Act had not been passed, have on and from the date of the death of such pensioner or member, a right or claim to payment by way of superannuation or otherwise under the provisions of *" The Police Act of 1937," in force immediately prior to the passing of this Act, shall continue to have such right or claim to the same extent as he or she would have had if this Act had not been passed, but not further or otherwise. Moreover the provisions of section thirty-five of *" The Police Act of 1937," in force immediately prior to the passing of this Act shall continue to apply with respect to deductions from the pay and salary or any payor salary of whatever amount derived after the date of the passing of this Act by any member of the Police Force whose retirement from the Police Force was approved or ordered by the Governor in Council before the passing of this Act and before such member reached the age of sixty years. * 1 G. 6 No. 12, v. 6, p. 922. 403 PREFERENCE IN EMPLOYMENT-WAR SERVICE.
