Police Act Amendment Act 1989, No. 52 591 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Police Act Amendment Act 1989. (2) In this Act the Police Act 1937-1988 is referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Police Act 1937-1989. 2. Amendment of s. 12. Disqualifications of constables . Section 12 of the Principal Act is amended by- (a) in subsection (1), omitting provision (a) and substituting the following provision- "(a)- (1) unless, in the case of a tormer member of the dueenslanci Police Force, he is under the age of 50 years; (ii) unless, in the case of a person who has previous police service approved by the Commissioner (other than as a member of the Queensland Police Force), he is under the age of 50 years;. unless, in the case of a person other than a person to whom provision (i) or (ii) applies, he is under the age of 40 years, is of good character and has otherwise complied with that prescribed by the rules, (b) in subsection (3)- (i) omitting the words "who is of or over the age of 35 years" and substituting the words "referred to in subsection (1) (a) (iii) who is of or over the age of 40 years"; (ii) omitting the words "under the age of 35 years" and substituting the words "under the age of 40 years". 3. Amendment of s. 14. Oath to be taken by members of the Police Force. Section 14 of the Principal Act is amended by- (a) in the note appearing in and at the beginning of the section inserting after the word "Oath" the words "or affirmation"; (b) omitting subsection (1) and substituting the following subsection:- "(1) No person appointed to be a member of the Police Force shall be capable of holding such office or of acting in any way therein until he has- (a) taken and subscribed the following oath:- "I, A.B., swear by Almighty God that I
592 Police Act Amendment Act 1989, No. 52 will well and truly serve our Sovereign Lady Queen Elizabeth the Second and Her Heirs and Successors according to law in the office of constable or in such other capacity as I may be hereafter appointed, promoted, or reduced, without favour or affection, malice or ill-will, from this date and until I am legally discharged; that I will see and cause Her Majesty's peace to be kept and preserved; and that I will prevent to the best of my power all offences against the same; and that while I shall continue to be a member of the Police Force of Queensland I will to the best of my skill and knowledge discharge all the duties legally imposed upon me faithfully and according to law. So help me God."; or (b) made and subscribed the following affirmation:- "I, A.B.,do solemnly, sincerely and truly affirm and declare that I will well and truly serve our Sovereign Lady Queen Elizabeth the Second and Her Heirs and Successors according to law in the office of constable or in such other capacity as I may be hereafter appointed, promoted, or reduced, without favour or affection, malice or ill-will, from this date and until I am legally discharged; that I will see and cause Her Majesty's peace to be kept and preserved; and that I will prevent to the best of my power all offences against the same; and that while I shall continue to be a member of the Police Force of Queensland I will to the best of my skill and knowledge discharge all the duties legally imposed upon me faithfully and according to law.", before a Justice of the Peace.". 4. Amendment of s. 15 . Oath equivalent to an agreement . Section 15 of the Principal Act is amended by- (a) in the note appearing in and at the beginning of the section inserting after the word "Oath" the words "or affirmation"; (b) inserting after the words "subscribing such oath" the words "or making and subscribing such affirmation".
