206 Police Act Amendment Act 1985, No. 17 BE IT ENACTED by the Queen 's Most Excellent Majesty , by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled , and by the authority of the same , as follows:- 1. Short title . This Act may be cited as the Police Act Amendment Act 1985. 2. Citation . (1) In this Act the Police Act 1937-1984 is referred to as the Principal Act. (2) The Principal Act as amended by this Act may be cited as the Police Act 1937-1985. 3. Amendment of s. 4 . Interpretation . Section 4 of the Principal Act is amended by, in the definition "Member of the Police Force ", inserting after the words "including every" the words "chief technical officer, chief scientific officer,". 4. Amendment of s. 6A. Deputy Commissioner . Section 6A of the Principal Act is amended by, in subsection (3), omitting the words "60 years" and substituting the words "retirement prescribed by section 36". 5. Amendment of s. 8 . Appointment of Superintendents , etc. Section 8 of the Principal Act is amended by- (a) in subsection (1), inserting after the word "inspectors," the words "chief technical officers, chief scientific officers,"; (b) in subsection (3), (i) inserting in paragraph (c) before the words "principal technical officers" the words "chief technical officers, chief scientific officers,"; (ii) inserting in sub-paragraph (i) of paragraph (c) after the words in charge of " the words "a section within"; (c) in subsection (6), omitting the words "Superintendents and inspectors" and substituting the words "Superintendents, chief technical officers, chief scientific officers, inspectors, principal technical officers and principal scientific officers"; (d) in subsection ( 8), inserting after the word "superintendents" the words", chief technical officers and chief scientific officers". 6. Amendment of s. 10. Appointment of sergeants , etc. Section 10 of the Principal Act is amended by- (a) in subsection ( 1), inserting after the words "other than" the words "chief technical officers, chief scientific officers,"; (b) in the third proviso to subsection ( 1), inserting after the words "other than" the words "a chief technical officer, a chief scientific officer,".
Police Act Amendment Act 1985, No. 17 207 7. Amendment of s. 36. Age of retirement. Section 36 of the Principal Act is amended by- (a) omitting subsection (1) and substituting the following subsection:- "(1) The age of retirement from the Police Force shall be- (a) in the case of the Commissioner, 65 years; (b) in the case of the Deputy Commissioner, 62 years; and (c) in the case of every other member of the Police Force, 60 years, and, subject to this section, every member of the Police Force shall retire from the Police Force upon attaining the age of retirement prescribed in his case."; (b) in subsection (2), omitting the words "and Deputy Commissioner, has attained the age of sixty years" and substituting the words "has attained the age of retirement prescribed in his case"; (c) omitting subsection (3) and substituting the following subsection:- "(3) In relation to a person continued as a member of the Police Force beyond the age of retirement pursuant to subsection (2), the expression "age of retirement", wherever occurring in this Part IV other than in this section, means- (a) where that person is the Deputy Commissioner, the age of 62 years; or (b) where that person is any other member, the age of 60 years, notwithstanding that such person is so continued.". 8. Amendment of s. 57A . Appeals by certain commissioned officers. Section 57A of the Principal Act is amended by, in subsection (1), inserting after the word "superintendent," the words "chief technical officer, chief scientific officer,".
