104 Police Act Amendment Act 1984, No. 13 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title . This Act may be cited as the Police Act Amendment Act 1984. 2. Principal Act and citation as amended . (1) In this Act the Police Act 1937-1980 is referred to as the Principal Act. (2) The Principal Act as amended by this Act may be cited as the Police Act 1937-1984. 3. Amendment of s. 4. Interpretation . Section 4 of the Principal Act is amended by, in the definition " Member of the Police Force ", omitting the words " (including the Chief Superintendent) ". 4. Amendment of s. 8. Appointment of Superintendents , etc. Section 8 of the Principal Act is amended by- (a) omitting subsection (2); (b) in subsection (3). (i) omitting the word " or " appearing between provision (va) and provision (vi); (ii) inserting after provision (vi) the following word and provision:- " or (vii) such other establishment as the Commissioner from time to time designates;"; (c) omitting subsection (7); (d) in subsection (8), omitting the words " the Chief Superintendent and ". 5. Amendment of s. 10. Appointment of sergeants , etc. Section 10 of the Principal Act is amended by inserting after subsection (1), the following subsections:- " (2) Notwithstanding the provisions of subsection (1) and section 12 (1) the Commissioner may, in a special case if it appears expedient in the interests of the Police Force so to do, with the approval of the Minister, appoint any person who is not a member of the Police Force to be a member of the Police Force and to carry out the duties of a technical or scientific officer (up to and including grade III), and if the Minister so approves, without limit of time in the first instance. (3) Prior to making an appointment pursuant to subsection (2) the Commissioner shall- (a) cause notification of the vacancy which it is intended to fill to be published in the Queensland Police Gazette inviting applications from members of the Police Force desirous of obtaining the appointment; (b) duly consider any applications received; and
Police Act Amendment Act 1984, No. 13 105 (c) if a suitable member of the Police Force is not available, certify that in his opinion there is no member of the Police Force available for such appointment who is capable of performing the functions and duties that will be assigned to the appointee upon appointment.". 6. Amendment of s. 12 . Disqualifications of constables . Section 12 of the Principal Act is amended by- (a) in subsection (1), in subparagraph (a), omitting the expression " 40 " and substituting the expression " 35 "; (b) in subsection (3), (i) omitting the words " forty years but under the age of forty-five years" and substituting the expression " 35 years"; (ii) omitting the word " forty " where secondly occurring and substituting the expression " 35 ". 7. Amendment of s. 57A. Appeals by certain commissioned officers. Section 57A of the Principal Act is amended by, in subsection (1), omitting the words " (including the Chief Superintendent) ". 8. Amendment of s. 67. Disposal of unclaimed and perishable property . Section 67 of the Principal Act is amended by adding at the end of subsection (1) the following paragraph:- " Where anything referred to in the preceding paragraph is located at a place and there is not at that place a person who is the holder of an auctioneer's licence under the Auctioneers and Agents Act1971-1981 the auction referred to in the preceding paragraph may be conducted by a person (duly appointed by the Commissioner to conduct the auction) who is not the holder of such a licence and notwithstanding the provisions of that Act that person may charge reasonable fees for conducting the auction.".
