No. 7 of 1972.

AN ACT to amend section sixty-one, section sixty-five and section seventy-five of the Police Act, 1892-1970.

[Assented to 25th May, 1972.1

RE it enacted by the Queen's Most Excellent

Majesty, by and with the advice and consent

of the Legislative Council and the Legislative

Assembly of Western Australia, in this present

Parliament assembled, and by the authority of the

same, as follows:—

1. (1) This Act may be cited as the Police Act Short title

and citation.

Amendment Act, 1972.

(2) In this Act the Police Act, 1892-1970, is Vol. 21

(3) The principal Act as amended by this Act

may be cited as the Police Act, 1892-1972.

Section 61

amended.

2. Section 61 of the principal Act is amended by substituting for the passage commencing with the word "Every", in line one, and ending with the word "Friday", in line five, the passage

Any person who, in any room or place, keeps by way of trade or business any billiard table or amusement machine, or any person having the care or management of any such room or place or in any manner assisting in conducting the business thereof who shall permit or suffer any person to play any game or machine on a Sunday except between the hours of ten o'clock in the forenoon and six o'clock in the afternoon, or on Christmas Day, or Good Friday .

Section 65

amended.

3. Section 65 of the principal Act is amended

(a)

in subsection (4a) by adding after the word "person", in line two, the words "or in his possession"; and

(b)

by adding after subsection (4a) a new sub- section as follows

(4b) Every person who, without lawful excuse, carries or has in his posses- sion any jumper leads, silver paper, wire hooks, cutting implements or other implement or device to facili- tate the unlawful driving or use of a motor vehicle. .

Section 75

amended.

4. Section 75 of the principal Act is amended

(a) by substituting for the passage commencing with the word "When" and ending with the passage "shall —", being the first six lines of subsection (1), the passage-

Where any goods or money charged to be stolen or unlawfully obtained and of which the owner is unknown are in the custody of a member of the Police Force then, if no person appears to claim ownership, that member after the expira- tion of a period of six months may and within a period of twelve months

shall—

; and

(b) by deleting subsection (3).
