AN ACT to amend the Police Act, 1892-1968.

[Assented to 16th May, 1969.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. (1) This Act may be cited as the Police Act

to a. 6.

2. Section six of the principal Act is amended

(a)

by deleting the passage "inspectors, sub-inspectors, or other", in lines one and two; and

(b)

by deleting the passage "inspectors, sub-inspectors, and other", in line five.

3. Section eight of the principal Act is

amended

(a)

by deleting the passage "inspector, sub- inspector, or other", in lines two and three; and

(b)

by substituting for the words "in any of the said offices", in line four, the words "for a commissioned officer".

4. Section sixteen of the principal Act is

amended

(a)

by adding after the section number "16." the subsection designation "(1)"; and

(b)

by adding a subsection as follows

(2) On the trial of a person charged with an offence under subsection (1) of this section the averment in the complaint that he was not at some particular time a member of the Police Force is sufficient evidence of the fact until the contrary is proved. .

5. Section sixteen A of the principal Act is

amended

(a) by adding after the section number "16A." the subsection designation "(1)"; and

(b) by adding a subsection as follows

(2) On the trial of a person charged with an offence under subsection (1) of this section the averment in the complaint that he was not at some particular time either a member of the Police Force of this State or a member of the Police Force of the Commonwealth or any other State of the Common- wealth is sufficient evidence of the fact until the contrary is proved. .

Section forty of the principal Act is amended

by deleting the passage "inspector, sub-inspector,

or any non-commissioned", in lines one and two.
