No. 26 of 1968.

AN ACT to amend the Police Act, 1892-1967.

[Assented to 25th October, 1968.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. (1) This Act may be cited as the Police Act	Short title.
and citation.

Amendment Act, 1968.

(2) In this Act the Police Act, 1892-1967 is Itaggidtg

referred to as the principal Act.	December,

(3) The principal Act as amended by this Act

may be cited as the Police Act, 1892-1968.

S. 76G

amended. 2. Section seventy-six G of the principal Act is

amended by deleting the word, "male" where it

appears

(a) in line one of subsection (1);

(b) in line one of subsection (2);

(c)	in line five of subsection (3); and
(d)	in the last line of subsection (3).

8. 99A

amended. 3. Section ninety-four A of the principal Act is

amended

(a) by adding immediately before the inter- pretation "Commissioner" in subsection (1), the following interpretation

"cannabis" means the plant known as Cannabis sativa, sometimes known as the marijuana plant, and includes any part of that plant; ;

(b) by adding after the interpretation, "prescribed", the following interpretation

"prohibited plant" means any prohibited plant under and for the purposes of the Poisons Act, 1964; ;

(c)	by deleting the word, "and" appearing immediately after paragraph (b) of sub- section (2);
(d)	by substituting for the passage, "drug." in the last line of paragraph (c) of sub- section (2), the passage, "drug;" ; and
(e)	by adding after paragraph (c) of subsection (2) the following paragraphs

(d) cannabis; and

(e) any prohibited plant.

4. Subsection (1) of section ninety-four B of P,;„943 ed.

the principal Act is amended

(a) by adding-

(i)   after the word, "in" in line one of paragraph (a);

(ii)    after the word, "any" in paragraph (b);

(iii)    after the passage, "of," in line four of paragraph (c); and

(iv)    after the word, "of" in line three of paragraph (d),

the words, "cannabis or", in each case; and

(b) by deleting paragraph (g) and substituting the following paragraph

(g) smokes or otherwise uses cannabis or prepared opium, or is found in any place which is then being used for the purpose of cannabis or opium smoking, .
