No. 6 of 1966

An Ordinance to amend the Police Ordinance

1927-1964.

Short title and

citation. 1.—(1.) This Ordinance may be cited as the Police

Ordinance 1966.*

(2.) The Police Ordinance 1927-1964f is in this Ordinance

referred to as the Principal Ordinance.

(3.) The Principal Ordinance, as amended by this Ordi-

nance, may be cited as the Police Ordinance 1927-1966.

Oath or

affirmation 2. Section 7 of the Principal Ordinance is amended by
equivalent to
agreement. omitting sub-sections (2.) and (3.).

3. After section 7 of the Principal Ordinance the following

sections are inserted:—

Resignation.

" 7AA.—(1.) A member of the Police Force shall not, with- out the written permission of the Minister or a person authorized by the Minister for the purposes of this section—

(a) resign from the Police Force; or

(b) cease to serve as a member of the Police Force.

Penalty: Fifty pounds or imprisonment for three months.

" (2.) The last preceding sub-section does not apply to a

member of the Police Force—

2, 1958; No. 21, 1959; No. 3, 1960; and No. 2, 1964.

(a) who, having given to the Commissioner notice in writing of his intention to resign from the Police Force, resigns from the Police Force on a date that is not earlier than three months, and not later than four months, after the date on which the notice was given; or

(b) who, having given to the Commissioner notice in writing of his intention to resign from the Police Force for the purpose of becoming a candidate for election as a member of a House of Parlia- ment of the Commonwealth or of a State, resigns

from the Police Force on a date that is not earlier than three months before the date appointed for the taking of the poll and is not later than the date on which the nominations for the election close.

" 7AB.—(1.) Where a member of the Police Force who, Appointment

having resigned after giving notice in accordance with para- whoha« graph (b) of sub-section (2.) of the last preceding section and to become having been a candidate at the election, has failed to be elected, "efiStonV makes application within two months after the declaration of
the result of the election, the Minister shall appoint him as a member of the Police Force under this section to a position not lower in rank than that held by him at the date of his resignation and at a remuneration and under terms and conditions not less favourable than those which were applicable to him at the date of his resignation.

"(2.) A person appointed under this section shall, for the purposes of his rights as a member of the Police Force, be deemed to have continued as a member of the Police Force as if he had not resigned but had been on leave of absence without pay during the period from the date on which his resignation took effect to and including the day immediately preceding the day on which he was appointed.".
