WH E R E A S by an A c t of t h e Governor and Council passed in t h e second year of the re ign of H e r Majesty Queen Vic tor ia
int i tuled " An Act for regulating the Police in the Towns uf Parra-

" matta Windsor Maitland Bathurst and other Towns respectively and, "for removing and preventing Nuisances and Obstructions and for the " better alignment of Streets therein " it was amongs t o ther th ings

enac ted t h a t i t should be lawful for t h e Governor from t i m e to t ime
by w a r r a n t unde r his h a n d to appoin t a J u s t i c e of t he Peace to

execute t h e duties of Police Mag i s t r a t e wi th in each of t h e said towns specified in t he said Act as well as wi th in each of such o ther towns in t he Colony of N e w South Wales as should be declared by H i s Exce l ­ lency t h e Governor by proc lamat ion to come u n d e r t h e opera t ion oL" the said A c t toge ther wi th such o ther dut ies as should be specified in the said A c t or as should be from t ime to t ime directed by t h e Governor for t he more efficient admin is t ra t ion of t he Police wi th in t he l imi t s of t h e said towns respectively unde r t he au tho r i t y of t he said Ac t or any o ther Ac t or Ord inance in force wi th in t h e said Colony A n d whereas it is expedient t h a t all such powers a n d au tho ­

ri t ies as m a y have been conferred on t h e Jus t i ces so appo in ted J>y the

Governor to execute t he duties of Police M a g i s t r a t e in each of t he said towns respectively should in cer tain cases be ex tended to and conferred on cer tain o ther Jus t i ces of t he Peace Be i t therefore enacted by H i s Excel lency the Governor of N e w South W a l e s w i t h

t he advice and consent of t h e Legis la t ive Counci l thereof Tha t from
and after t h e pass ing of th i s Ac t every Jus t i ce of t h e Peace shall have

all t he same powers and author i t ies wi th in t h e l imits of any of t h e said coun t ry towns of t h e said Colony in or n i g h to which h e has heretofore been or shall hereafter be; in t he hab i t of res iding as he would have h a d before t he pass ing of th i s Act if he h a d been duly appointed by t h e Governor to execute the duties of Pol ice Mag i s t r a t e wi th in such t o w n Prov ided never theless tha t th i s A c t shal l no t be deemed to apply to any such town as aforesaid in wh ich t h e r e m a y now or shall hereafter be a duly appoin ted Police Mag i s t r a t e in t h e performance of t h e dut ies imposed by t h e said reci ted Act .
