Poisons Regulations² (Amendment)

I, GARY FRANCIS PUNCH, the Minister of State for the Arts and Territories, pursuant to section 8 of the Interpretation Ordinance 1967, hereby make the following Regulations under the Poisons and Dangerous Drugs Ordinance 1933.

1. The following provisions of the Poisons Regulations are amended by omitting “Commissioner” (wherever occurring) and substituting “Service”:

Subregulation 4 (1) and paragraphs 16A (1) (a), 16A (2) (a), 16B (1) (c), 16B (2) (c) and 22 (b) and (d).

Schedule

2.  The Schedule to the Poisons Regulations is amended—

(a)by omitting “Commissioner, Capital Territory Health Commission” and substituting “Australian Capital Territory Community and Health Service”; and

(b)by omitting “Commissioner” and substituting—

“General Manager,

Australian Capital Territory

Community and Health Service”.

Transitional

3.  (1)  In this regulation, “former Commissioner” means a Commissioner within the meaning of the repealed Health Commission Ordinance 1975.

(2)  Where—

(a)at any time before 2 July 1988, an instrument was made, granted or issued, or an approval was given, by a former Commissioner under a provision of the Poisons Regulations amended by these Regulations; and

(b)the instrument or approval, as the case may be, had effect immediately before 2 July 1988;

then, on and after 2 July 1988—

(c)the instrument has effect as if it had been made, granted or issued by the Service; and

(d)the approval has effect as if it had been given by the Service;

under that provision as amended by these Regulations.

(3)  A reference in an instrument referred to in subregulation (2) (other than Regulations) to a former Commissioner shall, in relation to any act or thing done or to be done on or after 2 July 1988, be read as a reference to the Service.
