An Act to remove doubt as to the retrospective validation of certain regulations purporting to have been made under the Poisons Act, 1966; and to amend the Poisons (Amendment) Act, 1977. [Assented to, 20th October, 1977.1

Poisons {Regulations) Amendment.

BE it enacted by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows :—

1.     This Act may be cited as the “Poisons (Regulations) Short title.

Amendment Act, 1977”.

2.      (1) This Act, except section 4, shall commence on Commence-

the date of assent to this Act, but nothing in this subsection

affects the retrospective operation of section 3.

(2) Section 4 shall be deemed to have commenced

on 11th March, 1977.

3. (1) A regulation that— Validation of regulations

(a)	purports to have been made under the Poisons Act, purporting

under

(b)	was not validly made when it purported to be made	9̂ 5 ^"*
but would have then been validly made if the amendments made to the Poisons Act, 1966, by section 3 of and Schedule 1 to the Poisons (Amend­ ment) Act, 1977, had then been in force,

shall be deemed then to have been validly made and—

(c) shall be deemed to have had, during the period that commenced on the day on whieh it purported to be made and ended immediately before the date of assent to this Act; and

(d) shall have, on and after that date,

the same force and effect as it would have had if it had been

validly made on that day.

Poisons {Regulations) Amendment.

(2) A regulation referred to in subsection (1) may be rescinded, revoked, altered or varied as if it had been validly made.

(3) Without prejudice to the generality of subsection (1), that subsection has effect in relation to any act, matter or thing and in relation to any person in respect of any act, matter or thing, whether that act, matter or thing—

(a)	occurred or occurs, arose or arises or came or comes into existence ; or
(b)	was or is the subject of proceedings that were or are commenced,

before, on or after the date of assent to this Act.

Amendment	4.	The Poisons (Amendment) Act, 1977, is amended-
of Act No. 5, 1977.

Sec. 2. (a) by omitting from section 2 the matter relating to

(Schedules.) Schedule 4 ;

(b) by omitting section 5 ;
