884 POISONS AND DANGEROUS DRUGS O R D I N A N C E -

POISONS AND DANGEROUS DRUGS ORDINANCE.

POISONS REGULATIONS.*

REGULATIONS 1963. No. 2.f
Parts. 1. Regulation 2 of the Poisons Regulations is amended by omitting the

words—

" Part IV.—The sale of narcotic drugs."

and inserting in their stead the words—

" Part IV.—The sale of narcotic drugs, biological preparations and

restricted substances.".

Definitions. 2. Regulation 3 of the Poisons Regulations is amended by inserting,

before the definition of " the Ordinance ", the following definition:—

" ' restricted substance ' means a substance declared under section 40A of the Ordinance to be, for the purposes of the Ordinance, a restricted substance;".

Heading to 3 . The heading to Part IV. of the Poisons Regulations is repealed and
Part IV. the following heading inserted in its stead:—

" PART IV.—THE SALE OF NARCOTIC DRUGS, BIOLOGICAL PREPARA-

TIONS AND RESTRICTED SUBSTANCES.".

Prescriptions 4. Regulation 12 of the Poisons Regulations is amended by inserting,
to comply
with certain after the words " narcotic drug ", the words ", a biological preparation or a
conditions. restricted substance ".
Pharmacists 5. Regulation 13 of the Poisons Regulations is amended—
to observe
certain (a) by adding at the end of sub-regulation (1.) the words " , a
conditions in
dispensing biological preparation or a restricted substance ";

prescriptions.

(b) by adding at the end of paragraph (/) of sub-regulation (2.) the words " or which has, or appears to have, been written more than six months before its presentation "; and

(c) by adding at the end thereof the following sub-regulation:—
the Commonwealth Gazette and commenced on 13th June, 1963.

" (3.) The following conditions shall be observed by persons dispensing

prescriptions containing a biological preparation or restricted substance:—
(a) A person shall not dispense a biological preparation or a re-

stricted substance except upon a prescription complying with

these Regulations;

(Z>) A biological preparation or a restricted substance shall not be supplied more than once on the same prescription, except where the prescription so directs, in which case the preparation or substance may be supplied subject to the lapse of a specific interval or of specified intervals as directed in the prescription;

(c) The prescription shall be stamped, marked or inscribed in writing with the date on which it is dispensed, and with the name and business address of the person who dispensed it;

(d) The person who dispenses the prescription for the last occa- sion shall durably and legibly endorse the prescription with the word ' Cancelled ';

(e) A person shall not dispense a prescription endorsed as ' Cancelled' or which has, or appears to have, been written more than six months before its presentation;

(/) A person shall not dispense a prescription for a substance
containing a biological preparation or a restricted substance if
he has reason to believe that the prescription is not genuine;
(g) The label on the bottle or package containing a biological
preparation or a restricted substance shall be marked with the

identifying letters or number of the prescription as appearing

in the prescription book;

(h) The prescription book shall be kept at the place at which the drug is dispensed and shall at all reasonable times be pro- duced when demanded by an authorized person;

(i) A person shall not dispense a prescription which is illegible

or defaced or which appears to have been altered; and

(/) A prescription for a substance containing a biological preparation or a restricted substance which is suspected by a registered pharmacist to whom it is presented of having been forged or of having been fraudulently issued, or of not bearing the signature of a registered medical practitioner shall, notwith- standing that it is not dispensed, be retained by the registered pharmacist.".
