Poisons List Amendment Order (No. 4) 2002

I make the following order under section 14 of the Poisons Act 1971 .13 December 2002

1Short titleThis order may be cited as the Poisons List Amendment Order (No. 4) 2002 . 2CommencementThis order takes effect on the day on which its making is notified in the Gazette or on 1 January 2003, whichever is later. 3Principal OrderIn this order, the Poisons List Order 2001 is referred to as the Principal Order. 4Schedule 2 amended (Medicinal Poisons) Schedule 2 to the Principal Order is amended as follows: (a) by omitting item 2065 and substituting the following:

2065.  Hyoscine butylbromide, as the only therapeutically active substance, in divided preparations for oral use containing 20mg or less of hyoscine butylbromide per dosage unit in a pack containing 200mg or less of hyoscine butylbromide.

(b) by omitting item 2122 and substituting the following:

2122.	Pseudoephedrine in preparations (other than preparations for stimulant, appetite-suppression or weight-control purposes) with a recommended daily dose of 240mg or less of pseudoephedrine –
(a) in undivided preparations containing 60mg or less of pseudoephedrine per recommended dose; or
(b) when in combination with other therapeutically active substances; or
(c) in slow-release preparations.

5Schedule 3 amended (Potent Substances) Schedule 3 to the Principal Order is amended by inserting after item 3067 the following item:

3067M.  Pseudoephedrine in preparations (other than preparations for stimulant, appetite-suppression or weight-control purposes) with a recommended daily dose of 240mg or less of pseudoephedrine, where pseudoephedrine is the only therapeutically active substance, in divided preparations containing 60mg or less of pseudoephedrine per recommended dose in a pack containing 30 or less dosage units, except in slow-release preparations.

6Schedule 4 amended (Restricted Substances) Schedule 4 to the Principal Order is amended as follows: (a) by inserting after item 40029 the following:

40029M.  Agalsidase beta.

(b) by inserting after item 40548 the following:

40548H.  Drotrecogin alfa.

(c) by inserting after item 40684 the following:

40684M.  Fondaparinux.

(d) by inserting after paragraph (b) in item 40800 the following:

40800R.  Insulin-like growth factor I.

(e) by inserting after item 40805 the following:

40805M.  Ipriflavone.

(f) by inserting after item 41012 the following:

41012M.  Modafinil.

(g) by inserting after item 41098 the following:

41098M.  Obidoxime.

(h) by inserting after item 41110 the following:

41110M.  Olopatadine.

(i) by inserting after item 41242 the following:

41242M.	Polylactic acid in preparations for injection –
(a) for tissue augmentation; or
(b) for cosmetic use.

(j) by omitting item 41245 and substituting the following:

41245.  Polysulfated glycosaminoglycans in preparations for injection, except when separately specified in these Schedules.

(k) by omitting item 41305 and substituting the following:

41305.  Pseudoephedrine except when included in Schedule 2 or 3 .

(l) by inserting after item 41323 the following:

41323H.  Ractopamine except when included in Schedule 5 .

(m) by inserting after item 41530 the following:

41530M.  Tiotropium.

(n) by inserting after item 41556 the following:

41556M.  Travoprost.

7Schedule 5 amended (Domestic Poisons) Schedule 5 to the Principal Order is amended as follows: (a) by inserting after paragraph (e) in item 5031 the following:

5031F.  Betacyfluthrin in aqueous preparations containing 2.5% or less of betacyfluthrin.

(b) by omitting item 5170 and substituting the following:

5170.  3-iodo-2-propynyl butyl carbamate (Iodocarb) when in preparations containing 10% or less of 3-iodo-2-propynyl butyl carbamate, except when in aqueous preparations containing 10% or less of 3-iodo-2-propynyl butyl carbamate.

(c) by inserting after paragraph (b) in item 5267 the following:

5267M.  Prallethrin (cis:trans=20:80) in preparations containing 10% or less of prallethrin, except in insecticidal mats containing 1% or less of prallethrin.

(d) by inserting after item 5284 the following:

5284H.  Ractopamine in animal feed premixes containing 10% or less of ractopamine.

8Schedule 6 amended (Agricultural and Industrial Poisons) Schedule 6 to the Principal Order is amended as follows: (a) by inserting after item 6002 the following:

6002M.  Acetamiprid.

(b) by omitting item 6022 and substituting the following:

6022.	Arsenic –
(a) in ant poisons containing 0.4% or less of arsenic; or
(b) in animal feed premixes containing 4% or less of arsenic; or
(c) in preparations for the treatment of animals, except thiacetarsamide when included in Schedule 4  –
except when separately specified in this Schedule.

(c) by omitting item 6039 and substituting the following:

6039.  Betacyfluthrin in preparations containing 12.5% or less of betacyfluthrin, except when included in Schedule 5 .

(d) by omitting item 6096 and substituting the following:

6096.	Copper compounds except –
(a) when separately specified in these Schedules; or
(b) in preparations for human internal use containing 5mg or less of copper per recommended daily dose; or
(c) pigments where the solubility of the copper compound(s) in water is 1g per litre or less; or
(d) in feed additives containing 1% or less of copper; or
(e) in other preparations containing 5% or less of copper compounds.

(e) by omitting item 6105 and substituting the following:

6105.	Creosote except –
(a) when included in Schedule 2 ; or
(b) in preparations for human therapeutic use containing 10% or less of creosote; or
(c) in other preparations containing 3% or less of phenols and homologues of phenol boiling below 220oC.

(f) by inserting after paragraph (c) in item 6230 the following:

6230M.	3-iodo-2-propynyl butyl carbamate (Iodocarb) except –
(a) when included in Schedule 5 ; or
(b) in aqueous preparations containing 10% or less of 3-iodo-2-propynyl butyl carbamate.

(g) by omitting item 6336 and substituting the following:

6336.	Prallethrin (cis:trans=20:80) except –
(a) when included in Schedule 5 ; or
(b) in insecticidal mats containing 1% or less of prallethrin.

9Schedule 7 amended (Dangerous Poisons)Schedule 7 to the Principal Order is amended by omitting item 7023 from Part 1 and substituting:

7023.  Betacyfluthrin except when included in Schedule 5 or 6 .
