Poisons List Amendment Order (No. 4) 1999

I make the following order under section 15(1) of the Poisons Act 1971 .10 December 1999

1Short titleThis order may be cited as the Poisons List Amendment Order (No. 4) 1999 . 2CommencementThis order takes effect on the day on which its making is notified in the Gazette. 3Principal OrderIn this order, the Poisons List Order 1998 is referred to as the Principal Order. 4Schedule 2 amended (Medicinal Poisons) Schedule 2 to the Principal Order is amended as follows: (a) by omitting item 2026 and substituting the following:

2026.	Codeine when labelled with a recommended dose not exceeding 15mg of codeine and –
(a) compounded with aspirin, paracetamol or any one of their derivatives and no other analgesic substance in tablets or capsules each containing 10mg or less of codeine when –
(i) packed in blister or strip packaging or in a container with a child-resistant closure; and
(ii) in a primary pack containing 25 or less dosage units; or
(b) compounded with aspirin, paracetamol or any one of their derivatives and no other analgesic substance in individually wrapped powders each containing 10mg or less of codeine when in a primary pack containing 25 or less dosage units; or
(c) compounded with one or more other therapeutically active substances other than an antihistamine –
(i) in divided preparations each containing 10mg or less of codeine; or
(ii) in undivided preparations each containing 0.25% or less of codeine.

(b) by omitting item 2051 and substituting the following:

2051.  Glyceryl trinitrate except when included in Schedule 4 .

(c) by omitting item 2097 and substituting the following:

2097.  Phenylenediamines and alkylated phenylenediamines, for therapeutic use.

5Schedule 3 amended (Potent Substances) Schedule 3 to the Principal Order is amended by inserting after item 3040 the following items:

3040E.  Nicotinic acid for human therapeutic use except –

(a) in preparations containing 100mg or less of nicotinic acid per dosage unit; or

(b) nicotinamide.

3040M.  Nicotinyl alcohol except in preparations containing 100mg or less of nicotinyl alcohol per dosage unit.

6Schedule 4 amended (Restricted Substances) Schedule 4 to the Principal Order is amended as follows: (a) by inserting before item 40000M the following:

(b) in other preparations containing 1.5% or less of alpha-cypermethrin.

(b) by inserting after item 5023 the following:

5023M.  Benzalkonium chloride in preparations containing 10% or less of benzalkonium chloride except in preparations containing 5% or less of benzalkonium chloride.

(c) by inserting after item 5099M the following:

5099V.  Emamectin in preparations containing 2% or less of emamectin.

8Schedule 6 amended (Agricultural and Industrial Poisons) Schedule 6 to the Principal Order is amended as follows: (a) by inserting after item 6031 the following:

6031M.	Benzalkonium chloride except –
(a) when included in Schedule 5 ; or
(b) in preparations containing 5% or less of benzalkonium chloride.

(b) by inserting after item 6148 the following:

6148S.  Emamectin in preparations containing 5% or less of emamectin except when included in Schedule 5 .

(c) by omitting item 6292 and substituting the following:

6292.	Phenylenediamines and alkylated phenylenediamines not elsewhere specified in this Schedule or Schedule 2  –
(a) when used in hair dyes; or
(b) in preparations packed and labelled for photographic purposes; or
(c) in preparations packed and labelled for testing water, except in tablets containing 10mg or less of diethyl-para-phenylenediamine or dimethyl-para-phenylenediamine in opaque strip packaging, provided the directions for use include the statement –
Do not discard testing solutions into the pool.

(d) by omitting item 6317 and substituting the following:

6317.  Propoxur except when included in Schedule 5 .

(e) by omitting item 6383 and substituting the following:

6383.  Warfarin except when included in Schedule 4 or 5 .

(f) by omitting item 6390 and substituting the following:

6390.  Ziram in granular preparations.

9Schedule 7 amended (Dangerous Poisons) Schedule 7 to the Principal Order is amended as follows: (a) by inserting after item 7094 the following:

7094M.  Emamectin except when included in Schedule 5 or 6 .

(b) by inserting after item 7223 the following:

7224.  Ziram except when included in Schedule 6 .
