Poisons List Amendment Order (No. 3) 2009

I make the following order under section 15(1) of the Poisons Act 1971 .28 August 2009

1Short titleThis order may be cited as the Poisons List Amendment Order (No. 3) 2009 . 2CommencementThis order takes effect on the day on which its making is notified in the Gazette. 3Principal OrderIn this order, the Poisons List Order 2001 is referred to as the Principal Order. 4Schedule 2 amended (Medicinal Poisons) Schedule 2 to the Principal Order is amended as follows: (a) by inserting after item 2057 the following:

2057M.  Guaiphenesin in a modified release dosage form of 1200mg or less of guaiphenesin, with a recommended daily dose of 2400mg or less when not labelled for the treatment of children under 12 years of age.

(b) by omitting item 2062 and substituting the following:

2062.  Hydroquinone (excluding monobenzone and other alkyl ethers of hydroquinone included in Schedule 4 ) in preparations for human external therapeutic or cosmetic use containing 2% or less of hydroquinone except in hair preparations containing 0.3% or less of hydroquinone.

5Schedule 4 amended (Restricted Substances) Schedule 4 to the Principal Order is amended as follows: (a) by inserting after item 40046 the following:

40046M.  Alpha1-proteinase inhibitor (human).

(b) by inserting after item 40057 the following:

40057M.  Ambrisentan.

(c) by inserting after item 40158 the following:

40158M.  Bazedoxifene.

(d) by inserting after item 40345 the following:

40345M.  Cilostazol.

(e) by inserting after item 40431 the following:

40431M.  Dapoxetine.

(f) by inserting after item 40620M the following:

40620S.  Etravirine.

(g) by inserting after item 40707M the following:

40707S.  Gemtuzumab ozogamicin.

(h) by omitting item 40734 and substituting the following:

40734.	Guaiphenesin for human therapeutic use except –
(a) when included in Schedule 2 ; or
(b) in oral liquid preparations containing 2% or less of guaiphenesin; or
(c) in divided preparations containing 200mg or less of guaiphenesin per dosage unit.

(i) by omitting item 40767 and substituting the following:

40767.	Hydroquinone (other than its alkyl ethers separately specified in this Schedule) in preparations for human therapeutic or cosmetic use except –
(a) when included in Schedule 2 ; or
(b) in hair preparations containing 0.3% or less of hydroquinone.

(j) by inserting after item 40975M the following:

40975S.  Methylnaltrexone.

(k) by inserting after paragraph (b) in item 41209 the following:

41209M.  Phosphodiesterase type 5 inhibitors, except when separately specified in these Schedules.

(l) by inserting after item 41344 the following:

41344M.  Rivaroxaban.

(m) by inserting after item 41421 the following:

41421M.  Sugamaddex.

(n) by inserting after item 41536 the following:

41536M.  Tocilizumab.

6Schedule 5 amended (Domestic Poisons) Schedule 5 to the Principal Order is amended as follows: (a) by inserting after item 5105 the following:

5105K.	Diethylene glycol (excluding its salts and derivatives) in preparations containing not less than 10mg/kg of denatonium benzoate as a bittering agent, except –
(a) in paints or paint tinters; or
(b) in toothpastes or mouthwashes containing more than 0.25% of diethylene glycol; or
(c) in other preparations containing 2.5% or less of diethylene glycol.

(b) by omitting item 5126 and substituting the following:

5126.	Ethylene glycol (excluding its salts and derivatives) in preparations containing not less than 10mg/kg of denatonium benzoate as a bittering agent, except –
(a) in paints or paint tinters; or
(b) in toothpastes or mouthwashes containing more than 0.25% of ethylene glycol; or
(c) in other preparations containing 2.5% or less of ethylene glycol.

(c) by inserting after item 5276 the following:

5276M.	Prothioconazole-deschloro except in preparations containing 0.5% or less of prothioconazole-deschloro.
5276S.	Prothioconazole-triazolidinethione except in preparations containing 0.5% or less of prothioconazole-triazolidinethione.

7Schedule 6 amended (Agricultural and Industrial Poisons) Schedule 6 to the Principal Order is amended as follows: (a) by inserting after paragraph (b) in item 6135 the following:

6135M.	Diethylene glycol (excluding its salts and derivatives) except –
(a) when included in Schedule 5 ; or
(b) in paints or paint tinters; or
(c) in toothpastes or mouthwashes containing more than 0.25% of diethylene glycol; or
(d) in other preparations containing 2.5% or less of diethylene glycol.

(b) by omitting item 6175 and substituting the following:

6175.	Ethylene glycol (excluding its salts and derivatives) except –
(a) when included in Schedule 5 ; or
(b) in paints or paint tinters; or
(c) in toothpastes or mouthwashes containing more than 0.25% of ethylene glycol; or
(d) in other preparations containing 2.5% or less of ethylene glycol.

8Schedule 7 amended (Dangerous Poisons) Schedule 7 to the Principal Order is amended by inserting after item 7527 in Part 2 the following item:

7527M.  Ethylene glycol for use in toothpastes or mouthwashes except in preparations containing 0.25% or less of ethylene glycol.
