Poisons List Amendment Order (No. 2) 2000

I make the following order under section 15(1) of the Poisons Act 1971 .20 June 2000

1Short titleThis order may be cited as the Poisons List Amendment Order (No. 2) 2000 . 2CommencementThis order takes effect on the day on which its making is notified in the Gazette. 3Principal OrderIn this order, the Poisons List Order 1998 is referred to as the Principal Order. 4Schedule 2 amended (Medicinal Poisons) Schedule 2 to the Principal Order is amended as follows: (a) by omitting item 2011 and substituting the following:

2011.  Benzoyl peroxide in preparations for human external therapeutic use containing 10% or less of benzoyl peroxide, except in preparations containing 5% or less of benzoyl peroxide.

(b) by omitting item 2083 and substituting the following:

2083.  Naproxen in divided preparations containing 250mg or less of naproxen per dosage unit in packs of 30 or less dosage units.

5Schedule 3 amended (Potent Substances) Schedule 3 to the Principal Order is amended as follows: (a) by omitting item 3006 ; (b) by omitting item 3039S and substituting the following:

3039M.  Mometasone in aqueous nasal sprays delivering 50 micrograms or less of mometasone per actuation when the maximum recommended daily dose is no greater than 200 micrograms and when packed in a primary pack containing 200 actuations or less, for the treatment of seasonal allergic rhinitis in adults and children 12 years and over.

6Schedule 4 amended (Restricted Substances) Schedule 4 to the Principal Order is amended as follows: (a) by inserting after item 40114M the following:

40114S.  Becaplermin.

(b) by omitting item 40129 and substituting the following:

40129.	Benzoyl peroxide in preparations for human therapeutic use except –
(a) when included in Schedule 2 ; or
(b) in preparations for external use containing 5% or less of benzoyl peroxide.

(c) by inserting after item 40338M the following:

40338S.  Dalfopristin.

(d) by inserting after item 40431 the following:

40431M.  Dofetilide.

(e) by inserting after item 40452 the following:

40452M.  Eltenac.

(f) by inserting after item 40494 the following:

40494M.  Etonogestrel.

(g) by inserting after item 40725 the following:

40725M.  Melengestrol except when included in Schedule 6 .

(h) by omitting item 40800 and substituting the following:

40800.  Mometasone except when included in Schedule 3 .

(i) by inserting after item 40804V the following:

40804X.  Moxidectin in preparations for injection containing 10% or less of moxidectin except when included in Schedule 5 .

(j) by omitting item 40818 and substituting the following:

40818.  Naproxen except when included in Schedule 2 .

(k) by inserting after paragraph (b) in item 41034 the following:

41034E.  Quinupristin.

(l) by omitting item 41065 and substituting the following:

41065.	Selenium for therapeutic use except –
(a) when included in Schedule 3 , 6 or 7 ; or
(b) in preparations for oral human use with a recommended daily dose of –
(i) 26 micrograms or less of selenium in organic form; or
(ii) 52 micrograms or less of selenium in inorganic form; or
(c) for the treatment of animals –
(i) in solid, slow-release bolus preparations each weighing 100g or more and containing 300mg or less of selenium; or
(ii) in other divided preparations containing 30 micrograms or less of selenium per dosage unit; or
(iii) as elemental selenium, in pellets containing 100g/kg or less of selenium; or
(iv) in feeds containing 1g/tonne or less of selenium; or
(d) in preparations for topical use containing 2.5% or less of selenium sulphide.

7Schedule 5 amended (Domestic Poisons) Schedule 5 to the Principal Order is amended as follows: (a) by omitting item 5024 and substituting the following:

5024.	Benzoyl peroxide except –
(a) when included in Schedule 2 or 4 ; or
(b) in preparations containing 5% or less of benzoyl peroxide.

(b) by inserting after item 5028 the following:

5028S.  Buprofezin except in preparations containing 40% or less of buprofezin.

(c) by inserting after item 5052 the following:

5052S.  Copper hydroxide in preparations containing 50% or less of copper hydroxide except in preparations containing 12.5% or less of copper hydroxide.

(d) by omitting item 5081 and substituting the following:

5081.	Dichloromethane (methylene chloride) except –
(a) in preparations in pressurised spray packs labelled as degreasers, decarbonisers or paint strippers and containing 10% or less of dichloromethane; or
(b) in other preparations in pressurised spray packs; or
(c) in paints or tinters containing 5% or less of dichloromethane.

(e) by omitting item 5127 and substituting the following:

5127.  Fludioxonil except in preparations containing 10% or less of fludioxonil.

(f) by inserting after item 5264 the following:

5264M.  Sodium laureth-6 carboxylate except in preparations containing 1% or less of sodium laureth-6 carboxylate.

(g) by omitting item 5268 and substituting the following:

5268.  Sodium sulfide in preparations for metal treatment in containers each containing 50g or less of sodium sulfide.

(h) by inserting after paragraph (b) in item 5309 the following:

5309E.  3,6,9-trioxaundecanedioic acid except in preparations containing 5% or less of 3,6,9-trioxaundecanedioic acid, the pH of which is 3.5 or greater.

8Schedule 6 amended (Agricultural and Industrial Poisons) Schedule 6 to the Principal Order is amended as follows: (a) by omitting item 6017 and substituting the following:

6017.	Antimony compounds except –
(a) when included in Schedule 4 ; or
(b) antimony chloride in polishes; or
(c) antimony titanate pigments in paint; or
(d) in paints or tinters containing 5% or less of antimony.

(b) by omitting item 6026 and substituting the following:

6026.	Barium salts except –
(a) when included in Schedule 5 ; or
(b) barium sulfate; or
(c) in paints or tinters containing 5% or less of barium.

(c) by inserting after item 6054E the following:

6054M.  Butyric acid in preparations for use as insect lures.

(d) by omitting item 6056 and substituting the following:

6056.	Cadmium compounds except –
(a) when included in Schedule 5 ; or
(b) in paints or tinters containing 0.1% or less of cadmium.

(e) by inserting after item 6073 the following:

6073M.  (E)-(S)-1-(4-chlorophenyl)-4,4-dimethyl-2-(1H-1,2,4-triazol-1-yl)pent-1-en-3-ol (uniconazole-p) except in preparations containing 5% or less of (E)-(S)-1-(4-chlorophenyl)-4,4-dimethyl-2-(1H-1,2,4-triazol-1-yl)pent-1-en-3-ol.

(f) by omitting item 6080 and substituting the following:

6080.  Chromates (including dichromates) except in paints or tinters containing 5% or less of chromium as ammonium, barium, potassium, sodium, strontium or zinc chromates.

(g) by inserting after paragraph (d) in item 6087 the following:

6087S.	Copper hydroxide except –
(a) when included in Schedule 5 ; or
(b) in preparations containing 12.5% or less of copper hydroxide.

(h) by omitting item 6192 and substituting the following:

6192.  Formaldehyde (excluding its derivatives) except in preparations containing 5% or less of formaldehyde.

(i) by omitting item 6225 and substituting the following:

6225.	Lead compounds except –
(a) when included in Schedule 4 or 5 ; or
(b) in zinc-based paints or tinters containing 0.2% or less of lead as an impurity of the zinc; or
(c) in other paints or tinters containing 0.1% or less of lead; or
(d) in preparations for cosmetic use containing 100mg/kg or less of lead; or
(e) in pencil cores, finger colours, showcard colours, pastels, crayons, poster paints/colours or coloured chalks containing 100mg/kg or less of lead; or
(f) in ceramic glazes when labelled with the warning statement:
CAUTION – Harmful if swallowed. Do not use on surfaces which contact food or drink.
written in letters not less than 1.5mm in height.

(j) by inserting after paragraph (c) in item 6233 the following:

6233E.  Melengestrol acetate when used as an animal feed additive.

(k) by inserting after item 6234 the following:

6234S.  2-mercaptoethanol in preparations for use as insect lures.

(l) by inserting after item 6279 the following:

6279S.  Paraformaldehyde (excluding its derivatives) except in preparations containing 5% or less of formaldehyde.

(m) by inserting after paragraph (b) in item 6339 the following:

6339M.  Sodium sulfide in preparations for use as insect lures.

9Schedule 7 amended (Dangerous Poisons) Schedule 7 to the Principal Order is amended as follows: (a) by omitting item 7163 and substituting the following:

7163.  Moxidectin except when included in Schedule 4 , 5 or 6 .

(b) by omitting item 7195 and substituting the following:

7195.	Selenium except –
(a) when included in Schedule 6 ; or
(b) as selenium arsenide in photocopier drums; or
(c) in preparations for therapeutic use other than –
(i) drench concentrates containing 2.5% or less of selenium; or
(ii) pour-on preparations containing 0.5% or less of selenium; or
(d) in paints or tinters containing 0.1% or less of selenium; or
(e) in fertilisers containing 200g/tonne or less of selenium.
