Poisons List Amendment Order 2009

I make the following order under section 15(1) of the Poisons Act 1971 .29 April 2009

1Short titleThis order may be cited as the Poisons List Amendment Order 2009 . 2CommencementThis order takes effect on the day on which its making is notified in the Gazette. 3Principal OrderIn this order, the Poisons List Order 2001 is referred to as the Principal Order. 4Schedule 2 amended (Medicinal Poisons) Schedule 2 to the Principal Order is amended as follows: (a) by omitting item 2009 and substituting the following:

2009.	Atropine (excluding atropine methonitrate) for oral use –
(a) in undivided preparations containing 0.03% or less of total solanaceous alkaloids when labelled with a dose of 0.3mg or less of total solanaceous alkaloids and a recommended daily dose of 1.2mg or less of total solanaceous alkaloids; or
(b) in divided preparations containing 0.3mg or less of total solanaceous alkaloids per dosage unit when labelled with a recommended daily dose of 1.2mg or less of total solanaceous alkaloids.

(b) by inserting after paragraph (b) in item 2076 the following:

2077.  Ketotifen for ophthalmic use in preparations containing 0.025% or less of ketotifen.

5Schedule 3 amended (Potent Substances) Schedule 3 to the Principal Order is amended by omitting item 3045E . 6Schedule 4 amended (Restricted Substances) Schedule 4 to the Principal Order is amended as follows: (a) by inserting after item 40106 the following:

40106M.  Anidulafungin.

(b) by inserting after item 40456 the following:

40456M.  Desvenlafaxine.

(c) by omitting item 40609M and substituting the following:

40609M.  Ethylhexanediol for animal use.

(d) by omitting item 40838 and substituting the following:

40838.  Ketotifen except when included in Schedule 2 .

(e) by inserting after item 41350 the following:

41350M.  Romiplostim.

7Schedule 5 amended (Domestic Poisons) Schedule 5 to the Principal Order is amended by omitting item 5281M and substituting:

5281M.  Pyrithione zinc in paints containing 0.5% or less of pyrithione zinc calculated on the non-volatile content of the paint, except in paints containing 0.1% or less of pyrithione zinc calculated on the non-volatile content of the paint.

8Schedule 6 amended (Agricultural and Industrial Poisons) Schedule 6 to the Principal Order is amended as follows: (a) by omitting item 6029M and substituting the following:

6029M.	Basic Orange 31 (2-[(4-aminophenyl)azo]-1,3-dimethyl-1H-imidazolium chloride) except –
(a) in preparations for skin colouration and dyeing of eyelashes or eyebrows; or
(b) in hair dye preparations containing 1% or less of Basic Orange 31 when the immediate container and primary pack are labelled with the following statements, in letters not less than 1.5mm in height:
KEEP OUT OF REACH OF CHILDREN;
If in eyes wash out immediately with water;
WARNING – This product contains ingredients which may cause skin irritation to certain individuals. A preliminary test according to the accompanying directions should be made before use. This product must not be used for dyeing eyelashes or eyebrows; to do so may be injurious to the eye.

(b) by omitting item 6033 ; (c) by omitting item 6133 and substituting the following:

6133.	Didecyldimethylammonium salts except in preparations containing 1% or less of didecyldimethylammonium salts labelled with the statement –
Avoid contact with eyes.

(d) by omitting item 6205 and substituting the following:

6205.	Formaldehyde (excluding its derivatives) in preparations containing 0.05% or more of free formaldehyde except –
(a) for human therapeutic use; or
(b) in oral hygiene preparations; or
(c) in nail-hardener cosmetic preparations containing 5% or more of free formaldehyde; or
(d) in nail-hardener cosmetic preparations containing 0.2% or less of free formaldehyde when labelled with the statement:
PROTECT CUTICLES WITH GREASE OR OIL;
(e) in all other cosmetic preparations; or
(f) in other preparations containing 0.2% or less of free formaldehyde when labelled with the warning statement:
CONTAINS FORMALDEHYDE.

(e) by omitting item 6240 and substituting the following:

6240.	Lead compounds except –
(a) when included in Schedule 4 or 5 ; or
(b) in paints, tinters, inks or ink additives; or
(c) in preparations for cosmetic use containing 100mg/kg or less of lead; or
(d) in pencil cores, finger colours, showcard colours, pastels, crayons, poster paints/colours or coloured chalks containing 100mg/kg or less of lead; or
(e) in ceramic glazes when labelled with the warning statement, in letters not less than 1.5 mm in height:
CAUTION – Harmful if swallowed. Do not use on surfaces which contact food or drink.

(f) by omitting item 6265M and substituting the following:

6265M.	Methyl methacrylate (excluding its derivatives) except –
(a) for cosmetic use; or
(b) in preparations containing 1% or less of methyl methacrylate as residual monomer in a polymer.

(g) by omitting item 6306 and substituting the following:

6306.	Paraformaldehyde (excluding its derivatives) in preparations containing 0.05% or more of free formaldehyde except –
(a) for human therapeutic use; or
(b) in oral hygiene preparations; or
(c) in nail-hardener cosmetic preparations containing 5% or more of free formaldehyde; or
(d) in nail-hardener cosmetic preparations containing 0.2% or less of free formaldehyde when labelled with the statement:
PROTECT CUTICLES WITH GREASE OR OIL;
(e) in all other cosmetic preparations; or
(f) in other preparations containing 0.2% or less of free formaldehyde when labelled with the warning statement:
CONTAINS FORMALDEHYDE.

(h) by omitting item 6354 and substituting the following:

6354.	Pyrithione zinc except –
(a) when included in Schedule 2 or 5 ; or
(b) for human use in preparations for the treatment of the scalp containing 2% or less of pyrithione zinc when compliant with the requirements of the Required Advisory Statements for Medicine Labels; or
(c) in semi-solid hair preparations for animal use; or
(d) in shampoos for animal use containing 2% or less of pyrithione zinc when labelled with the statement "Keep out of eyes" and "If in eyes rinse well with water"; or
(e) when immobilised in solid preparations containing 0.5% or less of pyrithione zinc; or
(f) in paints, jointing materials or sealants containing 0.1% or less of pyrithione zinc calculated on the non-volatile content of the paint, jointing material or sealant.

9Schedule 7 amended (Dangerous Poisons) Schedule 7 to the Principal Order is amended as follows: (a) by inserting after item 7021 in Part 1 the following:

7021G.  Benomyl except in paints containing 0.5% or less of benomyl.

(b) by omitting item 7532M from Part 2 and substituting the following:

7532M.  Lead compounds in paints, tinters, inks or ink additives, except in preparations containing 0.1% or less of lead calculated on the non-volatile content of the paint, tinter, ink or ink additive.
