Poisons List Amendment Order 2005

I make the following order under section 15(1) of the Poisons Act 1971 .2 May 2005

1Short titleThis order may be cited as the Poisons List Amendment Order 2005 . 2CommencementThis order takes effect on the day on which its making is notified in the Gazette. 3Principal OrderIn this order, the Poisons List Order 2001 is referred to as the Principal Order. 4Schedule 2 amended (Medicinal Poisons) Schedule 2 to the Principal Order is amended as follows: (a) by omitting item 2032 and substituting the following:

2032.  Creosote derived from wood other than beechwood for human therapeutic use, except in preparations containing 10% or less of creosote derived from wood other than beechwood.

(b) by omitting item 2067 and substituting the following:

2067.	Hyoscyamus niger for oral use –
(a) in undivided preparations containing 0.03% or less of total solanaceous alkaloids when labelled with a dose of 0.3mg or less of total solanaceous alkaloids and a recommended daily dose of 1.2mg or less of total solanaceous alkaloids; or
(b) in divided preparations containing 0.3mg or less of total solanaceous alkaloids per dosage unit when labelled with a recommended daily dose of 1.2mg or less of total solanaceous alkaloids –
except in a pack containing 0.03mg or less of total solanaceous alkaloids.

(c) by omitting item 2121 . 5Schedule 4 amended (Restricted Substances) Schedule 4 to the Principal Order is amended as follows: (a) by inserting after item 40259 the following:

40259E.  Carbetocin.

(b) by inserting after item 40686 the following:

40686T.  Fosamprenavir.

(c) by omitting item 40832 ; (d) by inserting after item 40888 the following:

40888E.  Lumiracoxib.

(e) by inserting after item 41165M the following:

41165T.  Pemetrexed.

(f) by omitting item 41285 and substituting the following:

41285.  Propantheline.

(g) by omitting item 41378 and substituting the following:

41378.  Silicones for intra-ocular use.

6Schedule 5 amended (Domestic Poisons) Schedule 5 to the Principal Order is amended as follows: (a) by omitting item 5049 and substituting the following:

5049.	Chlorinating compounds containing 20% or less of available chlorine except –
(a) when separately specified in these Schedules; or
(b) sodium hypochlorite preparations with a pH of less than 11.5; or
(c) in liquid preparations containing not less than 2%, but not more than 4%, of available chlorine when labelled with the statement –
"WARNING: Ensure adequate ventilation when using. Vapour may be harmful. May give off dangerous gas if mixed with other products."; or
(d) in liquid preparations containing less than 2% of available chlorine; or
(e) in other preparations containing 4% or less of available chlorine.

(b) by omitting item 5055 and substituting the following:

5055.	Chlortetracycline in preparations –
(a) for topical application to animals for ocular use only; or
(b) containing 40% or less of chlortetracycline, when packed and labelled for the treatment of ornamental caged birds or ornamental fish only.

(c) by inserting after paragraph (c) in item 5080 the following:

5080M.  Cyhalofop-butyl.

(d) by omitting item 5090 and substituting the following:

5090.	Deltamethrin –
(a) in aqueous preparations containing 1% or less of deltamethrin, when no organic solvent, other than a glycol, is present; or
(b) in wettable granular preparations containing 25% or less of deltamethrin, when packed in child-resistant packaging each containing 3 grams or less of the formulation; or
(c) in water-dispersible tablets each containing 500mg or less of deltamethrin in child-resistant packaging; or
(d) in other preparations containing 0.5% or less of deltamethrin.

(e) by inserting after paragraph (b) in item 5144 the following:

5144E.  Flumiclorac pentyl.

(f) by omitting item 5243 and substituting the following:

5243.	Oxytetracycline in preparations –
(a) for topical application to animals for ocular use only; or
(b) containing 40% or less of oxytetracycline per dose, when packed and labelled for the treatment of ornamental caged birds or ornamental fish only.

(g) by omitting item 5250 and substituting the following:

5250.	Permethrin in preparations –
(a) containing 25% or less of permethrin; or
(b) for external use for the treatment of dogs and containing 50% or less of permethrin when packed in single-use containers having a capacity of 4mL or less –
except in preparations containing 2% or less of permethrin.

(h) by inserting after item 5258 the following:

5258M.  Pine oils (derived from Pinus radiata) in preparations containing 20% or less of pine oils when packed and labelled for use as a herbicide.

(i) by omitting item 5327 and substituting the following:

5327.	Tetracycline in preparations –
(a) for topical application to animals for ocular use only; or
(b) containing 40% or less of tetracycline, when packed and labelled for the treatment of ornamental caged birds or ornamental fish only.

7Schedule 6 amended (Agricultural and Industrial Poisons) Schedule 6 to the Principal Order is amended as follows: (a) by omitting item 6075M and substituting the following:

6075M.	Chlorinating compounds except –
(a) when included in Schedule 5 ; or
(b) when separately specified in these Schedules; or
(c) sodium hypochlorite preparations with a pH of less than 11.5; or
(d) in liquid preparations containing not less than 2%, but not more than 4%, of available chlorine when labelled with the statement –
"WARNING: Ensure adequate ventilation when using. Vapour may be harmful. May give off dangerous gas if mixed with other products."; or
(e) in liquid preparations containing less than 2% of available chlorine; or
(f) in other preparations containing 4% or less of available chlorine.

(b) by omitting item 6085M ; (c) by inserting after item 6093 the following:

6093M.  Clothianidin.

(d) by omitting item 6105 and substituting the following:

6105.	Creosote derived from wood other than beechwood except –
(a) when included in Schedule 2 ; or
(b) in preparations for human therapeutic use containing 10% or less of creosote derived from wood other than beechwood; or
(c) in other preparations containing 3% or less of phenols and homologues of phenol boiling below 220oC.

(e) by inserting after item 6110 the following:

6110M.  N-cyclohexyldiazeniumdioxy-potassium.

(f) by inserting after item 6227 the following:

6227T.  Iminoctadine trialbesilate.

(g) by inserting after paragraph (b) in item 6267 the following:

6267E.  Methylcyclopentadienyl manganese tricarbonyl in preparations containing 10% or less of methylcyclopentadienyl manganese tricarbonyl when fitted with a child-resistant closure.

(h) by omitting item 6326M and substituting the following:

6326M.  Pine oils (derived from Pinus radiata) when packed and labelled for use as a herbicide except when included in Schedule 5 .

(i) by inserting after item 6353 the following:

6353T.  Pyrithione copper.

(j) by omitting item 6365 and substituting the following:

6365.	Selenium –
(a) in preparations containing 2.5% or less of selenium when packed and labelled –
(i) for the blueing of gun barrels; or
(ii) for photographic purposes; or
(iii) for the colouring of lead or lead alloys; or
(b) in coated granules containing 1% or less of selenium for application to pasture except in fertilisers containing 200g/tonne or less of selenium; or
(c) for the treatment of animals –
(i) in a drench, injection, paste, stock lick, vaccine or horse feed supplement containing 0.5% or less of selenium; or
(ii) in animal feed premixes containing 2% or less of selenium for the preparation of feeds containing 1g/tonne or less of selenium; or
(iii) in controlled-release bolus preparations containing 25mg or less of selenium with a release rate not greater than 0.25mg/day; or
(iv) as barium selenate in preparations for injection containing 5% or less of selenium.

8Schedule 7 amended (Dangerous Poisons) Schedule 7 to the Principal Order is amended as follows: (a) by inserting after item 7060 in Part 1 the following:

7060M.	Creosote derived from beechwood.
7060P.	Creosote derived from coal.

(b) by inserting after item 7158 in Part 1 the following:

7158M.	Methylcyclopentadienyl manganese tricarbonyl except –
(a) when included in Schedule 6 ; or
(b) when used in laboratory analysis; or
(c) when packed for industrial use in containers with a nominal capacity of 100L or more.

(c) by omitting item 7541 from Part 2 and substituting the following:

7541.  Silicones for injection or implantation except when included in Schedule 4 .

9Schedule 8 amended (Narcotic Substances) Schedule 8 to the Principal Order is amended by inserting after item 8037 the following item:

8037M.  Ketamine.
