Poisons List Amendment Order 2001

I make the following order under section 14 of the Poisons Act 1971 .21 February 2001

1Short titleThis order may be cited as the Poisons List Amendment Order 2001 . 2CommencementThis order takes effect on the day on which its making is notified in the Gazette. 3Principal OrderIn this order, the Poisons List Order 1998 is referred to as the Principal Order. 4Schedule 2 amended (Medicinal Poisons) Schedule 2 to the Principal Order is amended as follows: (a) by inserting after item 2019 the following:

2019A.  Carbocisteine.

(b) by omitting items 2066 and 2066E and substituting the following:

2066.  Isosorbide dinitrate in oral preparations containing 10mg or less of isosorbide dinitrate per dosage unit.

(c) by omitting item 2072 and substituting the following:

2072.  Loperamide in preparations for oral use in packs of 20 dosage units or less.

5Schedule 3 amended (Potent Substances) Schedule 3 to the Principal Order is amended as follows: (a) by omitting item 3005M and substituting the following:

3005M.  Beclomethasone in aqueous nasal sprays delivering 50 micrograms or less of beclomethasone per actuation when the maximum recommended daily dose is no greater than 400 micrograms and when packed in a primary pack containing 200 actuations or less, for the short-term prophylaxis or treatment of seasonal allergic rhinitis in adults and children 12 years and over.

(b) by omitting item 3008E and substituting the following:

3008E.  Budesonide in aqueous nasal sprays delivering 50 micrograms or less of budesonide per actuation when the maximum recommended daily dose is no greater than 400 micrograms and when packed in a primary pack containing 200 actuations or less, for the short-term prophylaxis or treatment of seasonal allergic rhinitis in adults and children 12 years and over.

(c) by omitting item 3027M and substituting the following:

3027M.  Flunisolide in aqueous nasal sprays delivering 25 micrograms or less of flunisolide per actuation when the maximum recommended daily dose is no greater than 200 micrograms and when packed in a primary pack containing 200 actuations or less, for the short-term prophylaxis or treatment of seasonal allergic rhinitis in adults and children 12 years and over.

(d) by omitting item 3039M and substituting the following:

3039M.  Mometasone in aqueous nasal sprays delivering 50 micrograms or less of mometasone per actuation when the maximum recommended daily dose is no greater than 200 micrograms and when packed in a primary pack containing 200 actuations or less, for the short-term prophylaxis or treatment of seasonal allergic rhinitis in adults and children 12 years and over.

(e) by omitting item 3058 and substituting the following:

3058.	Triamcinolone acetonide –
(a) for the treatment of mouth ulcers, in preparations containing 0.1% or less of triamcinolone acetonide in a pack of 5g or less; or
(b) in aqueous nasal sprays delivering 55 micrograms or less of triamcinolone acetonide per actuation when the maximum recommended daily dose is no greater than 220 micrograms and when packed in a primary pack containing 120 actuations or less, for the short-term prophylaxis or treatment of seasonal allergic rhinitis in adults and children 12 years and over.

6Schedule 4 amended (Restricted Substances) Schedule 4 to the Principal Order is amended as follows: (a) by inserting after item 40386 the following:

40386A.  Difloxacin.

(b) by inserting after item 40470 the following:

40470A.  Etanercept.

(c) by omitting item 40575 and substituting the following:

40575.	Glyceryl trinitrate –
(a) in preparations for injection; or
(b) in transdermal preparations for the treatment of angina.

(d) by inserting after item 40629M the following:

40629N.  Infliximab.

(e) by omitting item 40649 and substituting the following:

40649.  Isosorbide dinitrate except when included in Schedule 2 .

(f) by omitting "in preparations for injection" from item 40650 in the table ; (g) by omitting item 40947 ; (h) by inserting "bromide" after "Pipenzolate" in item 40960 in the table ; (i) by inserting after item 41045 the following:

41045A.  Risedronic acid.

(j) by omitting "(triperidol)" from item 41206E in the table . 7Schedule 5 amended (Domestic Poisons) Schedule 5 to the Principal Order is amended as follows: (a) by inserting after item 5153 the following:

5153A.  Iodosulfuron-methyl-sodium.

(b) by inserting after item 5170 the following:

5170A.	Marjoram oil except –
(a) when packed in containers having a nominal capacity of 50mL or less fitted with a restricted flow insert, and labelled with the warning: KEEP OUT OF REACH OF CHILDREN; or
(b) in preparations containing 50% or less of marjoram oil.

(c) by inserting after item 5231 the following:

5231A.  Poly(oxy-1,2-ethanediyl),a-[2-[(2-hydroxyethyl)amino]-2-oxoethyl]-w-hydroxy-,mono-c13-15-alkyl ethers.

8Schedule 6 amended (Agricultural and Industrial Poisons) Schedule 6 to the Principal Order is amended as follows: (a) by inserting after item 6013 the following:

6013A.  Aminoethoxyvinylglycine except in preparations containing 15% or less of aminoethoxyvinylglycine.

(b) by omitting item 6017 and substituting the following:

6017.	Antimony compounds except –
(a) when included in Schedule 4 ; or
(b) antimony chloride in polishes; or
(c) antimony titanate pigments in paint; or
(d) in paints or tinters containing 5% or less of antimony calculated on the non-volatile content of the paint or tinter.

(c) by omitting item 6026 and substituting the following:

6026.	Barium salts except –
(a) when included in Schedule 5 ; or
(b) barium sulfate; or
(c) in paints or tinters containing 5% or less of barium calculated on the non-volatile content of the paint or tinter.

(d) by omitting items 6056 and 6057 and substituting the following:

6056.	Cadmium compounds except –
(a) when included in Schedule 5 ; or
(b) in paints or tinters containing 0.1% or less of cadmium calculated on the non-volatile content of the paint or tinter.
6057.	Cajuput oil except –
(a) when packed in containers having a nominal capacity of 15mL or less fitted with a restricted flow insert, and labelled with the following warnings:
(i) KEEP OUT OF REACH OF CHILDREN;
(ii) NOT TO BE TAKEN; or
(b) when packed in containers having a nominal capacity of 25mL or less fitted with a restricted flow insert and child-resistant closure, and labelled with the following warnings:
(i) KEEP OUT OF REACH OF CHILDREN;
(ii) NOT TO BE TAKEN; or
(c) in preparations containing 25% or less of cajuput oil; or
(d) in oils containing 25% or less of cajuput oil.

(e) by omitting item 6080 and substituting the following:

6080.  Chromates (including dichromates) except in paints or tinters containing 5% or less of chromium as the ammonium, barium, potassium, sodium, strontium or zinc chromates calculated on the non-volatile content of the paint or tinter.

(f) by omitting item 6082 and substituting the following:

6082.	Cineole except –
(a) when packed in containers having a nominal capacity of 15mL or less fitted with a restricted flow insert, and labelled with the following warnings:
(i) KEEP OUT OF REACH OF CHILDREN;
(ii) NOT TO BE TAKEN; or
(b) when packed in containers having a nominal capacity of 25mL or less fitted with a restricted flow insert and child-resistant closure, and labelled with the following warnings:
(i) KEEP OUT OF REACH OF CHILDREN;
(ii) NOT TO BE TAKEN; or
(c) in preparations containing 25% or less of cineole; or
(d) in oils containing 25% or less of cineole; or
(e) in rosemary oil or camphor oil (white).

(g) by omitting item 6122 and substituting the following:

6122.  Didecyldimethylammonium chloride except in preparations containing 1% or less of didecyldimethylammonium chloride labelled with the statement: AVOID CONTACT WITH EYES.

(h) by inserting after item 6197 the following:

6197A.	Glycolic acid (including its salts and esters) in cosmetic products except –
(a) in preparations for salon use only which are labelled in accordance with the National Occupational Health and Safety Commission’s National Code of Practice for the Labelling of Workplace Substances [NOHSC:2012 (1994)]; or
(b) in preparations containing 5% or less of glycolic acid; or
(c) in preparations containing 20% or less of glycolic acid with a pH of 3.5 or greater.

(i) by omitting item 6225 and substituting the following:

6225.	Lead compounds except –
(a) when included in Schedule 4 or 5 ; or
(b) in zinc-based paints or tinters containing 0.2% or less of lead as an impurity in the zinc and calculated on the non-volatile content of the paint or tinter; or
(c) in other paints or tinters containing 0.1% or less of lead calculated on the non-volatile content of the paint or tinter; or
(d) in preparations for cosmetic use containing 100mg/kg or less of lead; or
(e) in pencil cores, finger colours, showcard colours, pastels, crayons, poster paints/colours or coloured chalks containing 100mg/kg or less of lead; or
(f) in ceramic glazes when labelled with the statement, written in letters not less than 1.5 mm in height: CAUTION – HARMFUL IF SWALLOWED. DO NOT USE ON SURFACES WHICH CONTACT FOOD OR DRINK.

(j) by omitting item 6243 and substituting the following:

6243.  Methiocarb in preparations containing 20% or less of methiocarb except when included in Schedule 5 .

(k) by inserting after paragraph (b) in item 6271 the following:

6271A.	N,n-bis(phenylmethylene)-bicyclo-(2.2.1)heptane-2,5-dimethanamine except in preparations containing 1% or less of n,n-bis(phenylmethylene)-bicyclo-(2.2.1)heptane-2,5-dimethanamine, or a combination of n,n-bis(phenylmethylene)-bicyclo-(2.2.1)heptane-2,5-dimethanamine and n,n-bis(phenylmethylene)-bicyclo-(2.2.1)heptane-2,6-dimethanamine, when labelled with statements to the effect of:
(a) IRRITANT;
(b) REPEATED EXPOSURE MAY CAUSE SENSITISATION;
(c) AVOID CONTACT WITH EYES;
(d) AVOID CONTACT WITH SKIN;
(e) WEAR PROTECTIVE GLOVES WHEN MIXING OR USING;
(f) ENSURE ADEQUATE VENTILATION WHEN USING.
6271B.	N,n-bis(phenylmethylene)-bicyclo-(2.2.1)heptane-2,6-dimethanamine except in preparations containing 1% or less of n,n-bis(phenylmethylene)-bicyclo-(2.2.1)heptane-2,6-dimethanamine, or a combination of n,n-bis(phenylmethylene)-bicyclo-(2.2.1)heptane-2,5-dimethanamine and n,n-bis(phenylmethylene)-bicyclo-(2.2.1)heptane-2,6-dimethanamine, when labelled with statements to the effect of:
(a) IRRITANT;
(b) REPEATED EXPOSURE MAY CAUSE SENSITISATION;
(c) AVOID CONTACT WITH EYES;
(d) AVOID CONTACT WITH SKIN;
(e) WEAR PROTECTIVE GLOVES WHEN MIXING OR USING;
(f) ENSURE ADEQUATE VENTILATION WHEN USING.

(l) by omitting item 6292 and substituting the following:

6292.	Phenylenediamines and alkylated phenylenediamines not specified in Schedule 1 , 2 , 3 , 4 , 5 , 7 or 8  –
(a) in preparations packed and labelled for photographic purposes; or
(b) in preparations packed and labelled for testing water except tablets containing 10mg or less of diethyl-para-phenylenediamine or dimethyl-para-phenylenediamine in opaque strip packaging, provided the directions for use include the statement: DO NOT DISCARD TESTING SOLUTIONS INTO THE POOL; or
(c) in hair dyes except when the immediate container and primary pack are labelled with the following statements, in letters not less than 1.5mm in height:
(i) KEEP OUT OF REACH OF CHILDREN;
(ii) WARNING – THIS PRODUCT CONTAINS INGREDIENTS WHICH MAY CAUSE SKIN IRRITATION TO CERTAIN INDIVIDUALS. A PRELIMINARY TEST ACCORDING TO THE ACCOMPANYING DIRECTIONS SHOULD BE MADE BEFORE USE. THIS PRODUCT MUST NOT BE USED FOR DYEING EYELASHES OR EYEBROWS; TO DO SO MAY BE INJURIOUS TO THE EYE.

(m) by inserting after item 6321 the following:

6321A.	Pyrithione zinc except when included in –
(a)  Schedule 2 ; or
(b) semi-solid hair preparations; or
(c) shampoos containing 2% or less of pyrithione zinc.

(n) by omitting item 6331 and substituting the following:

6331.	Selenium –
(a) in preparations containing 2.5% or less of selenium when packed and labelled –
(i) for the blueing of gun barrels; or
(ii) for photographic purposes; or
(iii) for the colouring of lead or lead alloys; or
(b) in coated granules containing 1% or less of selenium for application to pasture except in fertilisers containing 200g/tonne or less of selenium; or
(c) in a drench, injection, paste, stock lick, vaccine or horse feed supplement containing 0.5% or less of selenium for the treatment of animals; or
(d) in animal feed premixes containing 2% or less of selenium when packed and labelled for the preparation of feeds containing 1g/tonne or less of selenium; or
(e) in controlled-release bolus preparations containing 25mg or less of selenium with a release rate not greater than 0.25mg/day for the treatment of animals.

(o) by omitting item 6368 and substituting the following:

6368.	Toluenediamine when included in hair dyes except when the immediate container and primary pack are labelled with the following statements, written in letters not less than 1.5mm in height:
(a) KEEP OUT OF REACH OF CHILDREN;
(b) WARNING – THIS PRODUCT CONTAINS INGREDIENTS WHICH MAY CAUSE SKIN IRRITATION TO CERTAIN INDIVIDUALS. A PRELIMINARY TEST ACCORDING TO THE ACCOMPANYING DIRECTIONS SHOULD BE MADE BEFORE USE. THIS PRODUCT MUST NOT BE USED FOR DYEING EYELASHES OR EYEBROWS; TO DO SO MAY BE INJURIOUS TO THE EYE.

9Schedule 7 amended (Dangerous Poisons) Schedule 7 to the Principal Order is amended as follows: (a) by inserting after item 7152 the following:

7152A.  Methiocarb except when included in Schedule 5 or 6 .

(b) by omitting item 7195 and substituting the following:

7195.	Selenium except –
(a) when included in Schedule 6 ; or
(b) as selenium arsenide in photocopier drums; or
(c) in preparations for therapeutic use other than –
(i) drench concentrates containing 2.5% or less of selenium; or
(ii) pour-on preparations containing 0.5% or less of selenium; or
(d) in paints or tinters containing 0.1% or less of selenium calculated on the non-volatile content of the paint or tinter; or
(e) in fertilisers containing 200g/tonne or less of selenium.
