2 Poisons (Fumigation) Amendment (No. 1) No. 108, 1994 ˙ Short title 1. This regulation may be cited as the Poisons (Fumigation) Amendment Regulation (No. 1) 1994 . ˙ Regulation amended 2. This regulation amends the Poisons (Fumigation) Regulation 1973 . ˙ Replacement of ss 1 and 2 3. Sections 1 and 2— omit, insert— ˙ ‘Short title ‘1. This regulation may be cited as the Poisons (Fumigation) Regulation 1973 . ˙ ‘Forms ‘2.(1) If a provision of this regulation requires a person to use an approved form, the Chief Health Officer must approve a form for the purpose of the provision. ‘(2) A person may ask the Chief Health Officer for a copy of a document setting out an approved form. ‘(3) The Chief Health Officer must comply promptly with the request. ’. ˙ Amendment of s 3 (Interpretation) 4.(1) Section 3 (definitions “Approved” , “Officer” , “Regulation” and “Schedule” )— omit. (2) Section 3— insert— ‘ “approved form” means a form approved by the Chief Health Officer under section 2; ’.
3 Poisons (Fumigation) Amendment (No. 1) No. 108, 1994 ˙ Replacement of ss 5–7 5. Sections 5 to 7— omit, insert— ˙ ‘Application for licence ‘5.(1) An application for a licence must be made to the Chief Health Officer in the approved form. ‘(2) The application must be accompanied by the application fee set out in the Schedule. ˙ ‘Time licence expires ‘6. A licence expires 1 year after the day the licence is granted unless it is cancelled by the Chief Health Officer or surrendered by the fumigator before the expiry day. ˙ ‘Application for renewal of licence ‘7.(1) An application for the renewal of a licence must be made to the Chief Health Officer in the approved form at least 14 days before the licence is due to expire. ‘(2) The application must be accompanied by the fee set out in the Schedule. ’. ˙ Amendment of s 25 6. Section 25— omit, insert— ˙ ‘Fumigator using certain poisons must have halide detector ‘25. A fumigator must not carry out fumigation using methyl bromide or ethylene dibromide at any place, unless the fumigator has at the place a working halide detector of a type approved by the Chief Health Officer. ’.
