Poisons (Exempted Public Institutions) Order 2010

I make the following order under sections 3(1) and 55(3) of the Poisons Act 1971 .26 May 2010

1Short titleThis order may be cited as the Poisons (Exempted Public Institutions) Order 2010 . 2CommencementThis order takes effect on the day on which its making is notified in the Gazette. 3Interpretation (1)  In this order – Act means the Poisons Act 1971 . (2)  The Acts Interpretation Act 1931 applies to the interpretation of this order as if this order were by-laws. 4Exempted public institutionsEach of the following institutions is declared to be a public institution for the purposes of the Act and an exempted public institution for the purposes of section 55 of the Act: (a) the Police Service; (b) the department responsible for the administration of the Police Offences Act 1935 .

Displayed and numbered in accordance with the Rules Publication Act 1953.

Notified in the Gazette on 9 June 2010

This order is administered in the Department of Health and Human Services.

EXPLANATORY NOTE

(This note is not part of the order) This order declares the Police Service and the Department of Police and Emergency Management to be –

(a) public institutions for the purposes of the Poisons Act 1971 ; and (b) exempted public institutions for the purposes of section 55 of that Act.
