Her Excellency the Governor, with the advice of the Executive Council, has made the following

Regulation under the Poisons and Therapeutic Goods Act 1966.

Explanatory note

The object of this Regulation is to amend the Poisons and Therapeutic Goods Regulation 2008 to enable appropriately trained pharmacists to supply and administer the influenza, measles-mumps-rubella combination and diphtheria-tetanus-pertussis vaccines without a prescription outside of retail pharmacies provided the pharmacists act in accordance with practice standards approved by the Secretary of the Ministry of Health.

This Regulation is made under the Poisons and Therapeutic Goods Act 1966, including sections 17(1) and
45C (the general regulation-making power).

1      Name of Regulation

This Regulation is the Poisons and Therapeutic Goods Amendment (Supply of

Vaccines by Pharmacists) Regulation 2020.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

3 Amendment of Poisons and Therapeutic Goods Regulation 2008

(1) Clause 48A Supply by pharmacists of certain vaccines

Omit “at a retail pharmacy” from clause 48A(1).

(2) Clause 48A(2)(g)
Omit “pharmacy”. Insert instead “place”.
