His Excellency the Governor, with the advice of the Executive Council, has made the following

Regulation under the Poisons and Therapeutic Goods Act 1966.

Explanatory note

The objects of this Regulation are to:

(a)

extend the types of vaccines a pharmacist may supply and administer without a prescription to include the measles-mumps-rubella combination vaccine and diphtheria-tetanus-pertussis combination vaccine, and

(b)

lower the minimum age (to 16 years old) of a person to whom a pharmacist is able to supply and administer those vaccines.

This Regulation is made under the Poisons and Therapeutic Goods Act 1966, including sections 17 and 45C
(the general regulation-making power).

1      Name of Regulation

This Regulation is the Poisons and Therapeutic Goods Amendment (Supply by

Pharmacists of Vaccines) Regulation 2018.

2      Commencement

This Regulation commences on 1 January 2019 and is required to be published on the
NSW legislation website.

3 Amendment of Poisons and Therapeutic Goods Regulation 2008

(1) Clause 48A Supply by pharmacists of certain vaccines

Insert before clause 48A (1):

(1A) This clause applies to the following vaccines:
(a) influenza vaccine,
(b) measles-mumps-rubella combination vaccine,
(c) diphtheria-tetanus-pertussis combination vaccine.
(2) Clause 48A (1) and (2)
Omit “an influenza vaccine” wherever occurring.
Insert instead “a vaccine to which this clause applies”.
(3) Clause 48A (1)
Omit “18 years old”. Insert instead “16 years old”.
(4) Clause 48A (1) (a)
Omit “a provider of continuing professional development who is”.
Insert instead “an education provider that is”.
(5) Clause 48A (1) (b)
Omit “Director-General”. Insert instead “Secretary”.
