Her Excellency the Governor, with the advice of the Executive Council, has made the following

Regulation under the Poisons and Therapeutic Goods Act 1966.

Explanatory note

The object of this Regulation is to amend the Poisons and Therapeutic Goods Regulation 2008 to reduce from 16 years of age to 10 years of age the minimum age of a person to whom a pharmacist is able to supply and administer an influenza vaccine without a prescription.

This Regulation is made under the Poisons and Therapeutic Goods Act 1966, including sections 17(1) and
45C (the general regulation-making power).

1      Name of Regulation

This Regulation is the Poisons and Therapeutic Goods Amendment (Supply and

Administration by Pharmacists) Regulation 2020.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

3 Amendment of Poisons and Therapeutic Goods Regulation 2008

(1) Clause 48A Supply by pharmacists of certain vaccines

Omit “to a person who is 16 years old or older” from clause 48A(1).

(2) Clause 48A(1AA)
Insert after clause 48A(1)—
(1AA) However, a pharmacist may not supply or administer a vaccine to which
this clause applies to a person who is—
(a) in relation to the measles-mumps-rubella combination vaccine and the diphtheria-tetanus-pertussis combination vaccine—under 16 years of age, and
(b) in relation to an influenza vaccine—under 10 years of age.
