His Excellency the Governor, with the advice of the Executive Council, has made the following
Regulation under the Poisons and Therapeutic Goods Act 1966.

Explanatory note
The object of this Regulation is to allow the email address or mobile phone number of a patient’s partner to be included on a prescription or a record of supply of a restricted substance, rather than the partner’s address, if the medical treatment includes prescribing or supplying azithromycin for the partner for the treatment of chlamydia.
This Regulation is made under the Poisons and Therapeutic Goods Act 1966, including sections 17 (1) (g) and (h) and 45C (the general regulation-making power).

1 Name of Regulation
This Regulation is the Poisons and Therapeutic Goods Amendment (Partner
Treatment—Chlamydia) Regulation 2016.
2 Commencement
This Regulation commences on the day on which it is published on the NSW legislation website.

[1] Clause 35 Form of prescription
Omit clause 35 (1) (b). Insert instead:
(b) if the treatment is for:
(i) a patient—the name and address of the patient, or (ii) an animal—the species of animal and the name and address of the animal’s owner, or
(iii) a patient’s partner and the prescription is for azithromycin for the treatment of chlamydia—the name and email address or mobile phone number of the partner,
[2] Clause 35 (7) and (8)
Insert after clause 35 (6):
(7) In this clause:
partner of a patient includes any of the following:
(a) the patient’s spouse, (b) the patient’s de facto partner, (c) a person with whom the patient is or was in a sexual relationship. (8) Subclauses (1) (b) (iii) and (7) cease to have effect on 1 January 2018.
[3] Clause 56 Records to be kept of certain supply of restricted substances
Omit clause 56 (b). Insert instead:
(b) must record:
(i) if the supply of the restricted substance is for a patient—the name and address of the patient, or (ii) if the supply of the restricted substance is for an animal—the species of the animal and the name and address of the animal’s owner, or
(iii) if the restricted substance is azithromycin and the supply is for a patient’s partner for the treatment of chlamydia—the name and email address or mobile phone number of the partner, and
[4] Clause 56 (2) and (3)
Insert at the end of clause 56:
(2) In this clause:
partner of a patient includes any of the following:
(a) the patient’s spouse, (b) the patient’s de facto partner, (c) a person with whom the patient is or was in a sexual relationship. (3) Subclauses (1) (b) (iii) and (2) cease to have effect on 1 January 2018.
