Her Excellency the Governor, with the advice of the Executive Council, has made the following
Regulation under the Poisons and Therapeutic Goods Act 1966.

Explanatory note
The object of this Regulation is to amend the Poisons and Therapeutic Goods Regulation 2008 to extend the circumstances in which a pharmacist may supply certain restricted substances to a person. This Regulation permits a pharmacist to supply to a person any oral hormonal contraceptive or statin lipid modifying agent covered by the National Health (Continued Dispensing) Determination 2012 of the Commonwealth if:
| (a) | the supply is made in accordance with the conditions of that determination, and |
| (b) | the supply is made in accordance with the Guidelines for the Continued Dispensing of eligible prescribed medicines by pharmacists, issued by the Pharmaceutical Society of Australia, and |
| (c) | the pharmacist is an approved pharmacist within the meaning of the National Health Act 1953 of the Commonwealth, and |
| (d) | the person is in immediate need of the substance for continuation of treatment. |
This Regulation is made under the Poisons and Therapeutic Goods Act 1966, including sections 10 (4) (d),
17 (1) (c) and 45C (the general regulation-making power).

1 Name of Regulation
This Regulation is the Poisons and Therapeutic Goods Amendment (Continued
Dispensing) Regulation 2013.
2 Commencement
This Regulation commences on the day on which it is published on the NSW legislation website.
3 Amendment of Poisons and Therapeutic Goods Regulation 2008
Clause 45A
Insert after clause 45:
45A Supply by pharmacists in accordance with determination under National
Health Act 1953 of Commonwealth
(1)
A pharmacist may supply a person with a restricted substance that is covered by the Continued Dispensing Determination under this clause if:
(a)
the supply is made in accordance with conditions that are specified in that determination, and
(b)
the supply is made in accordance with the document entitled Guidelines for the Continued Dispensing of eligible prescribed medicines by pharmacists, issued by the Pharmaceutical Society of Australia and as in force on 1 July 2012, and
(c)
the pharmacist is an approved pharmacist within the meaning of the National Health Act 1953 of the Commonwealth, and
(d)
the person is in immediate need of the substance for continuation of treatment.
(2) In this clause, Continued Dispensing Determination means the National Health (Continued Dispensing) Determination 2012 of the Commonwealth, as in force on the commencement of the Poisons and Therapeutic Goods Amendment (Continued Dispensing) Regulation 2013.
