An Act to amend the Poisons and Drugs Act 1978

[Notified in ACT Gazette S196: 5 October 1994]

The Legislative Assembly for the Australian Capital Territory enacts as follows:

Short title

1.  This Act may be cited as the Poisons and Drugs (Amendment) Act (No. 2) 1994.

Commencement

2.  This Act commences on the day on which it is notified in the Gazette.

Principal Act

3.  In this Act, “Principal Act” means the Poisons and Drugs Act 1978.1

Heading to Division 6A

4.  The heading to Division 6A of Part II of the Principal Act is omitted.

Interpretation

5.  Section 27A of the Principal Act is amended by omitting “Division” and substituting “Part”.

Substitution

6.  Section 27B of the Principal Act is repealed and the following section substituted:

Substances to which this Part applies

“27B.  This Part applies to prescribed restricted substances.”.

Unauthorised prescribing or supplying

7.  Section  27C of the Principal Act is amended by omitting “Division” and substituting “Part”.

Application for authorisation

8.  Section 27D of the Principal Act is amended by omitting from subsection (1) “Division” and substituting “Part”.

Grant of authorisation

9.  Section 27E of the Principal Act is amended by omitting from subsection (1) all the words after “if” (first occurring) and substituting “the person is in a class of persons prescribed in relation to the substance for which authorisation is sought”.

Dispensing

10.  Section 27F of the Principal Act is amended by omitting “Division” and substituting “Part”.
