Poisons Amendment Regulations (No. 5) 2010

Made by the Lieutenant-Governor and deputy of the Governor in
Executive Council.

1.             Citation

These regulations are the Poisons Amendment Regulations
(No. 5) 2010.

2.             Commencement

These regulations come into operation as follows —

(a) regulations 1 and 2 — on the day on which these regulations are published in the Gazette;
(b) the rest of the regulations — on the day on which the Pharmacy Act 2010 section 3 comes into operation.

3.             Regulations amended

These regulations amend the Poisons Regulations 1965.

4.             Regulation 2 amended

In regulation 2(1) insert in alphabetical order:

pharmacist’s licence means a licence to sell or supply

poison referred to in regulation 5;

pharmacy means a registered pharmacy as defined in
the Pharmacy Act 2010 section 3(1);

5.             Regulation 5 amended

In regulation 5 delete “registered under the Pharmacy Act 1964,
and”.

6.             Regulation 35A amended

In regulation 35A(1), (1a), (1c) and (2) delete “a graduate
trainee” and “graduate trainee” (each occurrence) and insert:

7.             Regulation 36AA amended

In regulation 36AA(4)(c) delete “registered under the Pharmacy
Act 1964”.

8.             Regulation 42 amended

(1) In regulation 42(1)(b) delete “licence is held under regulation 5;
and” and insert:
pharmacist’s licence is held; and
(2) After regulation 42(1)(d) insert:
and

9.             Regulation 50 amended

In regulation 50(a) before “hospital” insert:

public

10.           Regulation 51A amended

In regulation 51A(1) delete the definition of pharmacy.

11.           Appendix A Form 3 amended

In Appendix A Form 3 delete “PHARMACEUTICAL
CHEMIST’S” and insert:

PHARMACIST’S

12.           Various references to “pharmaceutical chemist” amended

In the provisions listed in the Table:

(a) delete “pharmaceutical chemist” (each occurrence) and insert:

pharmacist

(b) delete “pharmaceutical chemists” and insert:

pharmacists

(c) delete “Pharmaceutical Chemist” and insert:

pharmacist
