POISONS ACT 1964

POISONS AMENDMENT REGULATIONS (NO. 5) 1995

Made by His Excellency the Governor in Executive Council.

Citation

1.     These regulations may be cited as the Poisons Amendment Regulations

(No. 5) 1995.

Principal regulations

2.     In these regulations the Poisons Regulations 1965* are referred to as the

principal regulations.

Regulation 2 amended

3.     Regulation 2 of the principal regulations is amended in the definition of

"SUSDP" by deleting the paragraph designation "(b)" in the second place that it occurs and substituting the following paragraph designation -
Regulation 2A amended
4. Regulation 2A of the principal regulations is amended in paragraph (d)
by deleting "First or Second" and substituting the following -

First, Second or Third

Regulation 33B amended

5.     Regulation 33B (1) of the principal regulations is amended by deleting

"Schedule 1 or Schedule 2" and substituting the following -

the First, Second or Third Schedule

Regulation 35AA repealed and a regulation substituted

6.     Regulation 35AA of the principal regulations is repealed and the

following regulation substituted -

Products for vaginal use

35AA. A supplier shall ensure that nystatin, clotnmazole or

miconazo]e referred to in the Third Schedule shall not be sold in products for vaginaluse unless accompanied by guidelines
approved by the Commissioner of Health.

Regulation 38J amended

7.     The Table to regulation 38J of the principal regulations is amended by

inserting in the appropriate alphabetical order the following veterinary

drugs -

cloprostenol.

deslorelin.

enrofloxacin.

fluprostenol.
milbemycin oxime.
nicergoline.
prostianol.

tolfenamic acid.

Regulation 44A amended

8.     Regulation 44A (7) of the principal regulations is repealed and the

following subregulation is substituted -

chemist, authorized to possess and supply Eighth Schedule drugs, (7) For the purposes of subregulation (3), a pharmaceutical

who wishes to destroy drugs of addiction may have another pharmaceutical chemist authorized to possess and supply Eighth Schedule drugs as a witness to that destruction, but otherwise a witness shall not be a member of the same category as that of the person who seeks to destroy the drugs of addiction.

Regulation 51GA inserted

9.      After regulation 51G of the principal regulations the following regulation

is inserted —

Supply of dronabinol

51GA. A medical practitioner shall not supply, issue, write or authorize a prescription for delta-9-tetrah3rdrocannabinol (dronabinol) unless that practitioner has been authorized to do so by the Secretary of the Commonwealth Department of Human Services and Health under section 19 of the Therapeutic Goods Act 1989 of the Commonwealth.

Appendix K amended

10.      Appendix K to the principal regulations is amended by inserting in the

appropriate alphabetical position the following —
