POISONS ACT 1964

POISONS AMENDMENT REGULATIONS (NO. 5) 1993

Made by His Excellency the Governor in Executive Council.

Citation

1.     These regulations may be cited as the Poisons Amendment Regulations

(No. 5) 1993.

Commencement

2.     These regulations shall come into operation on the day on which the

Poisons (Scheduled Substances) Amendment Order (No. 5) 1993 comes into operation.

3.     In these regulations the Poisons Regulations 1965* are referred to as the

principal regulations.

Regulation 2A inserted

4.     After regulation 2 of the principal regulations the following regulation is

inserted —

"

Exemptions

2A. Excluding substances in the Eighth Schedule declared to be

poisons and specified drugs, the provisions of the Act do not apply

to —

(a)

poisons listed in Column 1 of Appendix G to the SUSDP in a product at a concentration the same or

(b)

poisons in a product listed in Appendix A to the SUSDP;

(c)

paints, except when prepared for medicinal or cosmetic purposes, which contain substances in the Fifth Schedule; and

(d)

paints, except when prepared for medicinal or cosmetic purposes, which contain poisons listed in the First or Second Schedule of Appendix P to the SUSDP, if —

(i)

the proportion of the poison is less than the proportion specified in those schedules; or

(ii)

the proportion of the poison is within the limits specified in those schedules and the container is labelled in accordance with the provisions of Appendix P of the SUSDP.
