Poisons Amendment Regulations 2010

I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the Poisons Act 1971 .26 July 2010

1Short titleThese regulations may be cited as the Poisons Amendment Regulations 2010 . 2CommencementThese regulations take effect on the day on which their making is notified in the Gazette. 3Principal RegulationsIn these regulations, the Poisons Regulations 2008 are referred to as the Principal Regulations. 4Regulation 74 amended (Authorisation to manufacture, &c., certain dangerous poisons) Regulation 74 of the Principal Regulations is amended as follows: (a) by omitting from subregulation (11) "A" and substituting "Subject to subregulation (12) , a"; (b) by omitting from subregulation (11)(c) "the Dangerous Substances (Safe Handling) Act 2005 or"; (c) by inserting the following subregulation after subregulation (11) : (12)  Subregulation (11) does not apply to a person who is the occupier of a facility that is – (a) a large dangerous substances location, within the meaning of the Dangerous Substances (Safe Handling) Act 2005 ; or (b) a major hazard facility, within the meaning of that Act.
