s1 2 s4 Poisons Amendment (No. 4) No. 405, 1994 ˙ Short title 1. This regulation may be cited as the Poisons Amendment Regulation (No. 4) 1994 . ˙ Commencement 2. This regulation commences on 1 December 1994. ˙ Regulation amended 3. This regulation amends the Poisons Regulation 1973 . ˙ Insertion of new s H3.04 4. After section H3.03— insert— ˙ ‘ Dispensing drugs to which pharmaceutical benefits scheme applies ‘ H3.04(1) This section applies if a dangerous or restricted drug is specified in a prescription by a brand name (the “specified drug” ) and the drug is also available under another brand name (the “substitute drug” ). ‘ (2) Despite section H3.02(f), a person dispensing the dangerous or restricted drug may dispense the substitute drug if— (a) the specified drug and the substitute drug are both drugs to which a pharmaceutical benefit applies under the Commonwealth Act; and (b) the person who prescribed the specified drug did not indicate on the prescription that only the specified drug was to be supplied; and (c) the Schedule of Pharmaceutical Benefits issued by the Commonwealth department within which the Commonwealth Act is administered states that the specified drug and the substitute drug are equivalent; and
s4 3 s4 Poisons Amendment (No. 4) No. 405, 1994 (d) a determination is in force under section 85(6) of the Commonwealth Act 1 for the substitute drug; and (e) it is lawful to dispense the substitute drug on prescription. ‘ (3) In this section— “Commonwealth Act” means the National Health Act 1953 (Cwlth).’.
