s1 2 s4 Poisons Amendment (No. 3) No. 155, 1995 ˙ Short title 1. This regulation may be cited as the Poisons Amendment Regulation (No. 3) 1995 . ˙ Regulation amended 2. This regulation amends the Poisons Regulation 1973 . ˙ Amendment of s A2.01 (Standard to be adopted) 3. Section A2.01— insert— ‘ (6) Amendment No. 3 of the relevant edition takes effect for the purposes of this regulation on 2 June 1995.’. ˙ Insertion of new s A6.04C 4. After section A6.04B— insert— ‘ ˙ Person may prescribe etc. delta -9-tetrahydrocannabinol only in certain circumstances ‘ A6.04C.(1) Subject to subsections (2) and (4) and section A6.05, a person must not prescribe, dispense, sell, lend, give away, supply or use the substance. ‘ (2) A doctor may prescribe, dispense, sell, lend, give away, supply or use the substance if— (a) the doctor is an approved doctor; and (b) the doctor prescribes, dispenses, sells, lends, gives away, supplies or uses the substance under the approval; and (c) the doctor writes, in his or her handwriting, the word ‘approved’ on the prescription for the substance. ‘ (3) The Chief Health Officer may give written approval for a doctor, or class of doctors, to prescribe, dispense, sell, lend, give away, supply or use the substance on conditions that the Chief Health Officer considers
s4 3 s4 Poisons Amendment (No. 3) No. 155, 1995 appropriate. ‘ (4) A pharmacist may dispense the substance under a prescription of an approved doctor if the prescription has written on it the word ‘approved’ in the doctor’s handwriting or in handwriting the pharmacist reasonably believes is the doctor’s. ‘ (5) In this section— “approved doctor” means a doctor, or a member of a class of doctors, to whom a written approval is given under subsection (3). “substance” means delta -9-tetrahydrocannabinol.’.
