Poisons (Amendment) Act 1993

An Act to amend the Poisons Act 1933

[Notified in ACT Gazette S23:  1 March 1993]

The Legislative Assembly for the Australian Capital Territory enacts as follows:

Short title

1.  This Act may be cited as the Poisons (Amendment) Act 1993.

Commencement

2.  (1)  Sections 1, 2 and 3 commence on the day on which this Act is notified in the Gazette.

(2) The remaining provisions commence on the day on which section 4 of the Poisons and Drugs (Amendment) Act 1993 comes into force.

Principal Act

3.  In this Act, “Principal Act” means the Poisons Act 1933.1

Interpretation

4.  Section 5 of the Principal Act is amended—

(a)by inserting in the definitions of “Poison” and “Poisonous substance” in subsection (1) “other than a poison within the meaning of the Poisons and Drugs Act 1978,” after “that person,”;

(b)by omitting from subsection (1) the definitions of “Container”, “Methylated spirit” and “Poisons Register”; and

(c)by omitting subsection (3).

Repeal

5.  Section 18, Part IV and sections 41 and 42 of the Principal Act are repealed.

Further amendments

6.  The Principal Act is amended as set out in the Schedule.

(a)Insert “or her” after “him”.

Paragraphs 50 (1) (b), (c) and (d)—

Insert “or her” after “his”.
